Section 1009.03 G. 3.ofthe Roseville City Code is amended to <br />6 read as follows: <br />7 <br />8 3. Denial Of Permit: No such permit will be allO'.ved ifit interferes '.'lith the use and <br />9 enjoyment of adjacent land or constitutes a danger to the public. In the event the <br />10 Chief Code Enforcement Officer determines that such a condition exists, the permit <br />11 shall not be granted. Permit Procedures: Applications for temporary signs shall be <br />12 filed with the City and processed in accordance with Minnesota Statutes 15.99 and <br />13 this Title. <br />14 <br />15 1. 1.Appeal Of Denial: The Chief Code Enforcement Officer's decision may be appealed <br />16 to the City Council. <br />17 <br />18 SECTION 4. Section 1014 of the Roseville City Code is amended to by adding <br />19 the following section: <br />20 <br />21 1014.04: BOARD OF ZONING ADJUSTMENTS AND APPEALS: <br />22 <br />23 The City Council shall act as the Board of Zoning Adiustments and Appeals pursuant to <br />24 Minnesota Statutes Chapter 462. Requests for variances. conditional use permits or other <br />25 approvals shall be processed by the Community Development Director or his or her <br />26 designee in accordance with the provisions of Chapter 1013 or other relevant section of <br />27 the City Code and Minnesota Statutes 15.99. <br />28 <br />29 An appeal from the ruling of the Community Development Director or his or her <br />30 designee regarding any interpretation of the legislative intent of Title 10 or 11 of the City <br />31 Code. or any action approving or denying an application related to any matter addressed <br />32 in Title 10 or 11 of the City Code may be filed in writing by any property owner or their <br />33 agent with the Community Development director within thirty (30) days after the making <br />34 of the order or decision being appealed. <br />35 <br />36 An appeal stays all proceedings and the furtherance of the action being appealed unless it <br />37 is certified to the Board of Adiustment and Appeals. after the notice of appeal is filed, <br />38 that by reason of facts stated in the certificate a stay would cause imminent peril to life <br />39 and property. In such case. the proceedings shall not be stayed other than by a restraining <br />40 order that may be granted by a court of record on application. and upon subsequent notice <br />41 to the City. <br />42 <br />43 The written appeal shall state the specific grounds upon which the appeal is made, and <br />44 shall be accompanied by a fee established by resolution of the City Council. A hearing <br />45 regarding the matter shall be held before the Planning Commission at its next regular <br />46 meeting consistent with the notice requirements and other procedures contained in <br />
