<br />1 to all buildings that may be erected, converted or structurally altered in shopping <br />2 center districts: <br /> <br />3 A.Setback Requirements: <br /> <br />4 1. Setbacks; Variances: Front, side, and rear yards shall be a minimum of one <br />5 hundred feet (100') for the shopping center building. Setbacks for side yards and <br />6 rear yards for the shopping center building adjacent to BI-B, B-2, B-3, B-4, B-6, <br />7 I-lor 1-2 zones shall be sixty feet (60'). Buildings and structures located on <br />8 outlots within the shopping center site shall meet the setbacks of the B-3 General <br />9 Business Zoning District. The owner or developer may, at owner or developer's <br />10 own option, submit a setback plan wherein design conditions or other <br />11 considerations indicate a variance to these requirements which would not conflict <br />12 with the general purpose and intent of this code. Consideration of such variances <br />13 shall be as stipulated in subsection 1013.02A of this title, and the city council may <br />14 impose such conditions thereto as may be appropriate. <br /> <br />15 2. Buffer Zone: Where a shopping center district abuts a residence district, any <br />16 new development shall include in the required setback a buffer zone not less than <br />17 a minimum of forty feet (40') in width abutting the residential district. This <br />18 protective strip shall contain no structures, shall not be used for parking, off-street <br />19 loading or storage, and shall be landscaped. The landscape treatment shall include <br />20 the seeding of grass or sodding ofthe whole of the buffer strip, the planting of <br />21 shrubbery and trees and maintaining of same, a compact screen wall, fence, <br />22 landscaping, or combination thereof, which limit shall be not less than seventy <br />23 five percent (75%) opaque year-round. <br /> <br />24 The planting or fence design must be approved by the city and shall be in <br />25 harmony with a residential neighborhood and provide sufficient screening of the <br />26 shopping center operations. <br /> <br />27 The landscape screening or fence shall be no less than six feet (6') at the time of <br />28 installation. Where a berm, wall, fence or combination thereof is required for <br />29 screening purposes for a commercial use adjacent to a residential use, such berm, <br />30 wall, fence or combination thereof shall be set back from the residential district <br />31 boundary at least three (3) times its height, and landscaped to screen fifty percent <br />32 (50%) of the surface of the berm, wall or fence at maturity ofthe plant materials <br />33 year-round. <br /> <br />34 3. Special Requirements When Rear Yard Includes Loading Area: Where a rear <br />35 yard of a shopping center district includes the loading and servicing area of a <br />36 shopping center building and where such a rear yard is adjacent to or across the <br />37 street from a residential district, the building setback shall be one hundred twenty <br />38 feet (120'), and the buffer strip shall be sixty feet (60'). <br /> <br />3 <br />
