<br />1006.04 <br /> <br />expansion and intensification of the use and <br />shall require modification of the plan and <br />improvements to the site in compliance with <br />the standards specified below for twenty <br />four (24) hour uses. (Ord. 1234, <br />12-15-1999, eff. 1-1-2000) <br /> <br />1006.05: GENERAL MINIMUM RE- <br />QUIREMENTS: In addition to <br />the design standard regulations specified in <br />chapter 1010 of this title, the following mini- <br />mum requirements as set forth in this chap- <br />ter shall apply to all buildings that may be <br />erected, converted or structurally altered in <br />shopping center districts: <br /> <br />A. Setback Requirements: <br /> <br />1. Setbacks; Variances: Front, side, <br />and rear yards shall be a minimum of <br />one hundred feet (100') for the shop- <br />ping center building. Setbacks for side <br />yards and rear yards for the shopping <br />center building adjacent 'to B1-B, B-2, <br />B-3, B-4, B-6, 1-1 or 1-2 zones shall be <br />sixty feet (60'). The owner or develop- <br />er may, at owner or developer's own <br />option, submit a setback plan wherein <br />design conditions or other consider- <br />ations indicate a variance to these <br />requirements which would not conflict <br />with the general purpose and intent of <br />this code, Consideration of such vari- <br />ances shall be as stipulated in sub- <br />section 1013.02A of this title, and the <br />city council may impose such condi- <br />tions thereto as may be appropriate. <br /> <br />2. Buffer Zone: Where a shopping <br />center district abuts a residence dis- <br />trict, any new development shall in- <br />clude in the required setback a buffer <br />zone not less than forty feet (40') in <br />width. This protective strip shall con- <br />tain no structures, shall not be used <br /> <br />January 2001 <br /> <br />City of Roseuille <br /> <br />1006.05 <br /> <br />for parking, off-street loading or stor- <br />age, and shall be landscaped. The <br />landscape treatment shall include the <br />seeding of grass or sodding, of the <br />whole of the buffer strip, the planting <br />of shrubbery and trees and maintain- <br />ing of same, a compact screen wall, <br />fence, landscaping, or combination <br />thereof, which limit shall be not less <br />than seventy five percent (75%) <br />opaque year-round. <br /> <br />The planting or fence design must be <br />approved by the city and shall be in <br />harmony with a residential neighbor- <br />hood and provide sufficient screening <br />of the shopping center operations. <br /> <br />The landscape screening or fence <br />shall be no less than six feet (6') at <br />the time of installation, Where a berm, <br />wall, fence or combination thereof is <br />required for screening purposes for a <br />commercial use adjacent to a residen- <br />tial use, such berm, wall, fence or <br />combination thereof shall be set back <br />from the residential district boundary <br />at least three (3) times its height, and <br />landscaped to screen fifty percent <br />(50%) of the surface of the berm, wall <br />or fence at maturity of the plant mate- <br />rials year-round. <br /> <br />3. Special Requirements When Rear <br />Yard Includes Loading Area: Where a <br />rear yard of a shopping center district <br />includes the loading and servicing <br />area of a shopping center building and <br />where such a rear yard is adjacent to <br />or across the street from a residential <br />district, the building setpack shall be <br />one hundred twenty feet (120'), and <br />the buffer strip shall be sixty feet <br />(60'). <br />
