LARKIN, HOFFMAN, DALY & LINDGREN, LTD.

The Honorable Mayor John Kysylyczyn
City Councilmembers
February 18,2000
Page 5

to residential areas by establishing additional screening and landscaping requirements and
restricting the types of activities that may occur during the hours of 10 p.m. to 7 a.m. These
performance standards require enclosed loading and trash areas for certain 24-hour uses.
Compliance with these new standards increases lot coverage and further penalizes owners of
Shopping Center District properties.

Lot coverage was not identified as a critical element of the shopping center moratorium
planning study. This is because the clear focus of the process was to establish new restrictions
to minimize impacts of late night Shopping Center District activities on residential uses.
Eliminating the lot coverage provision is not inconsistent with this objective.

. In Resource Strategies' opinion, the Code provisions that apply to the Shopping Center
District collectively provide "a safety net of performance standards which will function
effectively without a lot coverage standard. The simplest way to resolve the current problem is
to repeal the current standard. The repeal of the lot coverage standard would have no negative
effect on the extraordinary setbacks, buffering, height restriction or 24-hour use restrictions
that are in place in the SC District."

Bradley appreciates the opportunity to provide input into the City Council's deliberations on the lot
coverage provision. Bradley hopes that the information provided in this letter will be helpful in ensuring
a productive discussion at the February 22 work session.

~IY'
~r,~

LARKIN, HOFFMAN, DALY & LINDGREN, Ltd.

Enclosures
cc: Steve Sarkozy, City Manager
Joel Jamnik, City Attorney
Dennis Welsch, Community Development Director
Thomas Paschke, City Planner
Tim Prinsen, Bradley Real Estate
Dick Heuer, Bradley Real Estate
Bob Shadduck, Jerrys
Lloyd Johnson, SuperValu
Greg Kopischke, Westwood Professional Services
Craig Mevissen, Planmark

0558168.01
