<br />DRAFT 6-26-00 <br />Proof of Parking Agreement <br /> <br />THIS AGREEMENT, Made and entered into this _day of <br />20_, by and between , a <br />("Grantee") and CITY OF <br />ROSEVILLE, a Minnesota municipal corporation (the "City); <br /> <br />A. Grantee is the fee owner of certain real property ("Property") located in the <br />City ofRoseville, County of Ramsey, State of Minnesota, legally described_on Exhibit A <br />attached hereto and hereby made a part hereof; and <br /> <br />B. Grantee proposes to <br />("Project"), which is to include parking and landscaping to be used in connection <br />therewith (the Project and said parking and landscaping being hereinafter called the <br />"Improyements"); and <br /> <br />C. The Property currently has C-> parking spaces on <br />site but would need C-> parking spaces, following <br />completion of the proposed Project, to comply with the City's zoning ordinances; and <br /> <br />D. Grantee has submitted to the City a parking plan prepared by <br />dated , 20_ ("Plan"). which Plan provides <br />for a total of _ parking spaces, in compliance with City code requirements, to be <br />constructed on the Property; a copy of which Plan is on file with the City and which Plan <br />is incorporated herein by reference; and <br /> <br />E. Grantee is of the opinion that _ parking spaces are not required for the <br />operation of the Project and Improyements, and has requested from the City Council a <br />temporary parking variance allowing the construction of the proposed Project with <br />additional parking spaces being added only if needed in the future; and <br /> <br />F. The City did, on ,20_, in Planning File No. <br />grant the requested yariance because strict enforcement of the City Code would, in this <br />case, cause undue hardship because of circumstances unique to the Property, and the <br />grant of such yariances has been detennined by the City to be in keeping with the spirit <br />and intent of the applicable ordinances, but the parking variance was temporary only and <br />was conditioned upon the execution, deliyery, and recording of this Agreement, and upon <br />the conditions hereinafter set out in this Agreement, which the City deems necessary to <br />impose to ensure compliance with the applicable City ordinances and to protect adjacent <br />. properties; an1. <br /> <br />G. Grantee is agreeable to the granting ofthe temporary parking variance <br />subject to the conditions hereinafter set out, and is willing, and represents that it has the <br />power and authority, to enter into this Agreement; and <br />
