<br />---. <br />,:.- <br /> <br />G.;13/\x~J/A~. ff ~ <br />~ ~\q4- <br /> <br />i' <br />Paschke, Thomas <br /> <br />From: <br />Sent: <br />To: <br />Subject: <br /> <br />Paschke, Thomas <br />Tuesday, March 11, 2003 10:20 AM <br />'Sue Rhodes' <br />RE: Fence behind our property, <br /> <br />Sue & Larry; <br /> <br />The City has provided a number of correspondences to Heritage Realty, Supervalu, Jerry <br />Foods, and Kraus Anderson indicating the landscaping placed along the south and west <br />sides of the parking lot does not meet the requirements of Section 1006.05F City Code. <br />Specifically, this Section of the Code reads: "24 hour uses within 300 feet of a residential <br />district shall provide screening of parking and driving areas adjacent to residential areas. <br />The screening, which must have a minimum opacity of 90% year-round and a minimum <br />height of 6 feet, may be provided by landscaping, walls, fence, berms, or combinations <br />thereof. " <br /> <br />Last year the landscape architect for the project passed away. This created an unfortunate <br />situation further hampering the process. A different landscape architect (not familiar with <br />the code or the project) was brought in to review the landscaping, which analysis <br />concluded that the landscaping (in their opinion) met the approved plan and City Code <br />requirement. <br /> <br />Since their response/ analysis, the I have had conversations with Kraus Anderson regarding <br />the south and west parking lot landscaping. Unfortunately, I have had varying success <br />with the individuals involved in the project on completing specific site issues. However, to <br />date only the landscape issue remains. As recent as last week I had a conversation with the <br />general contractor on the landscape item and once again expressed our position that it <br />does not meet the City Code and needs to be addressed. I was informed that they would <br />discuss our position and provide me with a response. A meeting between the contractor <br />and City has not been ruled out. <br /> <br />Given the options spelled out in the City Code, I cannot promise that a fence will be <br />installed to meet the screening requirements. I am also sorry that you feel I have not <br />listened to your concerns. I share your concern, however, I am limited in my ability and/ or <br />the methods used to obtain site plan compliance.
