It is our understanding that this grocery store will be open 24- <br />hours per day, <br /> <br />As well, I would like to thank you and your "team" for being present at the Development Review <br />Committee (DRC) meeting of January 30, 2001 to answer questions related to the proposed Cub <br />Foods grocery store and associated site improvements, Since the January 30 meeting, the DRC <br />has completed the site plan and use confonnity review of the proposed grocery store use in the <br />southernmost portion of Har Mar Mall. The DRC has detennined that the proposed grocery store <br />would occupy land zoned SC (Shopping Center District) for which a grocery store is a pennitted <br />use, However, as you are aware, Har Mar Mall has been detennined to be a non-confonning use <br />due to its building coverage to lot area ratio (see Section 1006,02C), Pursuant to Section <br />1011,02 of the Roseville City Code, a non-conforming use may be continued but may not be <br />extended, expanded, intensified or changed unless to a confonning use. <br /> <br />The DRC has reviewed the proposed interior remodeling plan and has concluded that the <br />proposed interior demolition and improvements do not extend, expand, intensify or change the <br />use of the mall in a manner that impacts the non-conforming use provisions of the Roseville City <br />Code, Further, the exterior facade treatment creating a canopy along the south side of the <br />structure is not considered additional floor area of the building, <br /> <br />However, because the proposal would establish a new 24-hour use, as defined by Section <br />1002,02 of the Roseville City Code, certain site improvements are required to reduce impacts to <br />adjacent residential property owners, In the case of the Cub Foods proposal, this facility must <br />meet all applicable requirements specified in Ordinance 1234, effective on January 1, 2000, <br />
