The <br />proposed vacated easement area would be replaced by a new easement along the eastern part <br />of the pond resulting in a more attractive pond that has equal capacity and functionality. <br />(legal descriptions attached). <br /> <br />BACKGROUND <br /> <br />Ryan Companies is requesting the utility/drainage easement vacation in connection with the <br />three phase Veritas development. The first phase of the development includes site grading, <br />utility installation, and construction of a five-story office building. <br /> <br />The area surrounding the office structure incorporates generous green space areas for <br />employees to recreate and relax. One such area modifies the northwest portion of the <br />existing storm water pond. This modification includes re-grading the pond at the northwest <br />location to create a unique open space area and adequate space for the relocated trail. The <br />pond will also be re-graded on the east to provide the required holding capacity. <br /> <br />Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. A public <br />hearing is required. The Planning Commission holds the hearing and recommends action on <br />the vacation request to the City Council. <br /> <br />The city policy is to assist property owners, where engineering is possible, to vacate, <br />relocate, and upgrade utilities and property at the property owner's expense. <br /> <br />STAFF COMMENTS <br /> <br />Unlike recent utility and drainage easement vacations, this requested easement vacation does <br />not involve the relocation of any public utilities.
