<br />-------.--- -.- <br /> <br />fP~~ <br /> <br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 06/10/02 <br />ITEM NO: <br /> <br /> <br />Manager Approved: <br /> <br />Agenda Section: <br />HEARINGS <br /> <br />1.0 BACKGROUND <br /> <br />1.1 Periodically the Community Development staff reviews Code violations relating to property <br />maintenance to determine whether there are properties in disrepair for extended periods. The <br />staff spends time attempting to gain voluntary compliance during the year on these properties. <br />Generally, they have not met the Code because the owner has been absent, unable (physically or <br />financially), or unwilling to comply with the Code. Property abatement is one remedy. It <br />allows the City to order corrections and assess the property for the work. This process has <br />been used in previous years to secure buildings from vandals and weather, clean up buildings, <br />paint and/or restore siding, plug rodent holes, repair windows and fix failing garage roofs and <br />doors. <br /> <br />1.2 The staff attempts to work with property owners to bring the structure into compliance (and <br />continues to encourage property owners to repair properties up to the time of a Council hearing). <br />The hearing is an opportunity for the property owners to address the property repair issues, <br />estimated costs of repair, and suggest alternatives to the abatement process. The process is <br />attached. <br /> <br />1.3 The City goals within the comprehensive plan are protect and improve property values (Goals <br />3,4, and 5; page 6 and 7, Section 3) and to adhere to performance standards which protect the <br />integrity of commercial areas and neighborhoods (Policy 6, page 8, Section 3). <br /> <br />1.4 The conditions that prompted the abatement action (and the recent repairs completed by <br />the property owner) include: <br /> <br />o The gas station property is vacant and closed. <br /> <br />o Light panels are broken and missing <br />./ On May 27th some panels were replaced; however, the <br />replacements were old, damaged panels from other buildings and <br />still constitute a nuisance violation (407.02J & K) because of their <br />condition. <br /> <br />./ <br /> <br />o Doors are not secured. <br />./ On May 27th the doors were secured. <br /> <br />o Entire structure is in need of painting due to peeling paint. <br /> <br />o The site is littered with pallets, tires, fencing, a broken cabinet and <br />other debris. <br /> <br />1 <br />
