Capistrant <br />2036 North Victoria Street <br />Roseville, MN 55113 <br /> <br />RE: Check Return/or Variance Application. <br /> <br />Dear Mr. Capistrant: <br /> <br />On April 5,2000 you submitted an application for a side yard setback variance to construct a <br />four-stall garage up to your property line. The Development Review Committee (DRC) <br />considered your application for completeness and determined that it could not proceed with the <br />request. The application was rejected due to City Policy and Codes regarding structure setback <br />and distance from property line. The DRC could not support a setback variance that would place <br />a structure on the property line and felt you could not meet the required "hardship" or <br />"alternative design" tests. The City notified you of this action and met with you to review <br />alternatives, one of which was to pursue a Setback Permit. <br /> <br />On April 25, the DRC reviewed your revised submittal andrequest for a Setback Permit, <br />determining that the request did not meet the purpose and intent of the Setback Permit process. <br />The City notified you of the DRC determination and discussed possible options for you to <br />pursue. <br /> <br />In summary, your application for a side yard setback variance was determined to be incomplete <br />and not possible to process for consideration by the Planning Commission or the City Council. <br />Subsequently, your file has been closed and I am returning your check that covered the variance <br />application fee. <br /> <br />Should you require further assistance with your garage project, please do not hesitate to call me <br />at 651.490.2236. <br /> <br /> <br />Attachment: <br /> <br />2660 Civic Center Drive <.
