<br />WHEREAS, the Roseville City Council made the following findings: <br /> <br />3404262 <br /> <br />1 Section 1016.22Al (Non-Conformities) stipulates that non-conformities can continue but are <br />subject to applicable State Statutes and City Ordinance regarding alterations, repair after <br />damage, discontinuance of use, and intensification of use. <br /> <br />2 The Shoreland Ordinance requires lots to have a width of 1 00 feet adjacent a shoreline and <br />is 15,000 square feet in size. <br /> <br />3 The former home, initially constructed in 1910 prior to the establishment of the City of <br />Roseville, is situated on a lot 40 feet in width and 167 feet in depth, encompassing 6,690 <br />square feet <br /> <br />4 A variance requires the applicant to prove physical hardship and to demonstrate that no <br />practical alternatives exist that would reduce the need for a variance. <br /> <br />5 The unique physical features of the property (i.e. shape and size of lot) create a physical <br />hardship. <br /> <br />6 The hardship is not the applicant's creation. <br /> <br />7 The property cannot be put to a reasonable use if used under the conditions permitted by the <br />ordinance. <br /> <br />8 If granted, the variance will not impact the health, safety, or general welfare of the <br />community. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") ofthe City of <br />Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a variance to Section 1016.22Al <br />(Non-Conformities) and Section 10 16.26B 1 (Storm Water Management) allowing redevelopment of <br />the parcel with a single family home and allowance for 32% impervious land area for property at <br />391 Owasso Boulevard South (PID # 012923210005) be approved. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Mastel, and upon vote being taken thereon, the following voted in favor: Mastel, Maschka, <br />Wiski, Goedeke and Kysylyczyn <br /> <br />and the following voted against the same: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />~J <br />
