REQUEST FOR COUNCIL ACTION Date: October 6, 2014 Item No.: 11.a Department Approval City Manager Approval Item Description: Public Hearing for County Road D Reconstruction Project to be assessed in 2014 B ACKGROUND 1 On September 8, 2014 the City Council set a date to hold a public hearing for the purpose of 2 establishing special assessments for City Project P-ST-SW-W-13-02: County Road D 3 Reconstruction, between Lexington Avenue and Victoria Street. It is suggested that the public 4 hearing be conducted according to the attached agenda. Notices have been mailed as required to 5 the affected properties. 6 At the assessment hearing, staff will go through a brief presentation that will include a 7 description of the project, project financing, and a discussion of typical assessments for 8 properties benefiting from these improvements. Staff will summarize the City assessment policy 9 and how it has been applied to this project. 10 It is suggested that if property owners have individual concerns about the quality of construction 11 as part of the project or specific information about project deficiencies, these should be referred 12 to the Engineering Department. Typically, these kinds of complaints relate to quality of finished 13 construction and are covered under the warranty. The warranty is one year from the final 14 contract acceptance; the Contract was finalized on September 2, 2014. Correction of these types 15 of problems should not delay the adoption of assessment rolls. 16 In reviewing the final assessment roll for the purpose of the public hearing staff did encounter 17 one corner property that per city assessment policy should have only been assessed for 10% of 18 the County Road D frontage based on a previous assessment of 100% of their frontage along 19 Chatsworth Street as a part of project 96-02. This has been corrected on the attached 20 Assessment Roll and the property owner has been notified of the reduction in assessment. 21 Following past Council policy, if questions are brought up during the Public Hearing regarding 22 specific assessments, if amendments to the assessment rolls are necessary, or if Council would 23 like staff to investigate a concern, the hearing can be continued to the next city council meeting. 24 We would then need to ask Ramsey County for an extension to certify the assessments with them 25 th which is due in early November. If the hearing is extended to the October 27 meeting, we will 26 th accept payment until November 26 and would not be able to certify the assessments with the 27 st County until December 1. 28 This project has been completed in accordance with the plans and specifications and there are no 29 unresolved problems with the construction according to the final review of the City of Shoreview 30 which administered and inspected this project. 31 Page 1 of 2
