REQUEST FOR COUNCIL ACTION <br /> Date: October 6, 2014 <br /> Item No.: 11.a <br />Department Approval City Manager Approval <br />Item Description: Public Hearing for County Road D Reconstruction Project to be assessed <br />in 2014 <br />B <br />ACKGROUND <br />1 <br />On September 8, 2014 the City Council set a date to hold a public hearing for the purpose of <br />2 <br />establishing special assessments for City Project P-ST-SW-W-13-02: County Road D <br />3 <br />Reconstruction, between Lexington Avenue and Victoria Street. It is suggested that the public <br />4 <br />hearing be conducted according to the attached agenda. Notices have been mailed as required to <br />5 <br />the affected properties. <br />6 <br />At the assessment hearing, staff will go through a brief presentation that will include a <br />7 <br />description of the project, project financing, and a discussion of typical assessments for <br />8 <br />properties benefiting from these improvements. Staff will summarize the City assessment policy <br />9 <br />and how it has been applied to this project. <br />10 <br />It is suggested that if property owners have individual concerns about the quality of construction <br />11 <br />as part of the project or specific information about project deficiencies, these should be referred <br />12 <br />to the Engineering Department. Typically, these kinds of complaints relate to quality of finished <br />13 <br />construction and are covered under the warranty. The warranty is one year from the final <br />14 <br />contract acceptance; the Contract was finalized on September 2, 2014. Correction of these types <br />15 <br />of problems should not delay the adoption of assessment rolls. <br />16 <br />In reviewing the final assessment roll for the purpose of the public hearing staff did encounter <br />17 <br />one corner property that per city assessment policy should have only been assessed for 10% of <br />18 <br />the County Road D frontage based on a previous assessment of 100% of their frontage along <br />19 <br />Chatsworth Street as a part of project 96-02. This has been corrected on the attached <br />20 <br />Assessment Roll and the property owner has been notified of the reduction in assessment. <br />21 <br />Following past Council policy, if questions are brought up during the Public Hearing regarding <br />22 <br />specific assessments, if amendments to the assessment rolls are necessary, or if Council would <br />23 <br />like staff to investigate a concern, the hearing can be continued to the next city council meeting. <br />24 <br />We would then need to ask Ramsey County for an extension to certify the assessments with them <br />25 <br />th <br />which is due in early November. If the hearing is extended to the October 27 meeting, we will <br />26 <br />th <br />accept payment until November 26 and would not be able to certify the assessments with the <br />27 <br />st <br />County until December 1. <br />28 <br />This project has been completed in accordance with the plans and specifications and there are no <br />29 <br />unresolved problems with the construction according to the final review of the City of Shoreview <br />30 <br />which administered and inspected this project. <br />31 <br />Page 1 of 2 <br />
