The
property in question has been sold. The new owner is pro-
posing to develop this property. They have prepared site
plans, building plans, and so forth, that are different
than those as proposed by ZiIT~erman Realty.

In view of the above it is our opinion that any extension
of variances to height limitations or special use permits
are no longer valid.

It may well be that the fact that the City has, in the past,
granted a height variance, could be used as an argument to
grant height variances to the new property owners. That is,
however, only an argument to be considered by the City Council
together with all other factors.

/'-

r::~j;~

RCB: gVF'
encl.

jVERSj /..

/ \/Jj/
I --() ,
J ,--,/
/

....i
//" I
. ,/

~@

-'--'~--'-~'~~-"-'~.""''''~.'I;..,.''''',\''~,.,. ~...~~
