The history of <br />this property is substantially as fo11m...s: <br /> <br />1. On July 17, 1972, the City Council <br />of the City of Rosevllle granted to <br />Zimmermlln Realty a rezoning from R-l <br />to B-IB, approved a special use permit <br />and granted a variance as to height <br />limitations. <br /> <br />.2. Subsequently two lawsuits were commenced <br />in Ramse] County District Court as1dn<j <br />for a. deteL,nination of the City Council's <br />actions. They bear Ramsey County District <br />Court File ~os. 386921 and 392495. <br /> <br />The seconc1 1awsui t referred to above involved a lil,^'Gui t <br />by various property owners challenging the Council's <br />action. This matter was not finally determined until <br />June 14, 1974, when the Ch.y of Roseville approved a <br />Stipulation wherein the property owners waived their <br />rights to appeal to the Supreme Court and the City <br />w~ived certain rights to tax costs. <br /> <br />'rhe other litigation which involved a lawsuit by Zimmerman <br />Realty was not resolved until 1975. <br /> <br />The City Code of the City of Rosev.ille provides in part <br />a.s follows: <br />
