<br />. l ... <br /> <br />3404257 <br /> <br />3 A variance requires the applicant to prove physical hardship and to demonstrate that no <br />practical alternatives exist that would reduce the need for a variance. <br />4 The unique location of the property adjacent to County Road C, a rail line, and across from <br />industrial uses adversely impacts the privacy and safety of the applicant and his family. <br /> <br />5 The hardship is not the applicant's creation. <br /> <br />6 The property cannot be put to a reasonable use if used under the conditions permitted by the <br />ordinance. A four-foot high fence would not provide adequate screening from County Road <br />C, the rail line, and adjacent industrial uses. <br /> <br />7 If granted, the variance will not impact the health, safety, or general welfare of the <br />community. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City of <br />Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a 2-112 foot variance to Section <br />lOl2.02B2 (Yard & Open Space Requirements) allowing a 6-1/2 foot tall fence to be constructed in <br />the front yard for the property located at 2655 Sheldon Street (PID # 032923340089) be approved, <br />subject to: <br /> <br />1. A fence height of 6-1/2 feet. <br />2. The fence being located in the exact location as the white picked fence. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Goedeke, and upon vote being taken thereon, the following voted in favor: Goedeke, Wiski, <br />Mastel, Maschka and Kysylyczyn <br /> <br />and the following voted against the same: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />j <br />
