Consider Presumptive Penalty Approval—Super America Store#4115 Alco- <br /> hol Compliance Failure <br /> Police Lt. Rosand reviewed the specifics of this Super America Store#4115 alco- <br /> hol compliance failure as detailed in the RCA dated September 22, 2014. <br /> Super America Representative <br /> Bill Schnobrich,Director of Operations for all Super America Stores <br /> In speaking directly to the date confusion from 1985 to 1995, Mr. Schnobrich ad- <br /> vised that the employee was simply not paying attention, and due to this and other <br /> employment violations they'd become aware of, had been terminated the next <br /> day. Due to other issues related to employment, Mr. Schnobrich opined that it <br /> would not have mattered the date on the identification card. Mr. Schnobrich clari- <br /> fied that the employee in question had been properly trained. Mr. Schnobrich ad- <br /> vised that this violation occurred thirty days away from Super America's semi- <br /> annual training program, which consisted of an electronic video training; and not- <br /> ed that this store, including all their stores, received their training through an elec- <br /> tronic video training program. Mr. Schnobrich further advised that this store, in- <br /> cluding all their stores, receive a monthly secret shopper done by a third party <br /> contractor to ensure there are no violations for tobacco or alcohol, and there had <br /> been no failures in that particular store over the last nineteen months through <br /> those random checks. Mr. Schnobrich noted that their Roseville stores employ <br /> the policy to card all alcohol purchases. <br /> Mayor Roe thanked Mr. Schnobrich for the firm's due diligence, for his attend- <br /> ance tonight, and for providing the details of the compliance failure. <br /> Lt. Rosand opined that the Super America training set the bar for all businesses <br /> doing alcohol compliance, and offered his favorable impression with their training <br /> records and his working relationship with local staff; wishing that all businesses <br /> kept similar records. <br /> Mayor Roe noted that this spoke well for their responsible citizenship. <br /> Lt. Rosand advised that the firm, assuming the presumptive penalty would be im- <br /> posed, had already paid the fee, and he had the check available to forward to the <br /> Finance Department, pending the City Council's action tonight. <br /> With Councilmember Laliberte addressing the off-sale suspension as indicated, <br /> Mayor Roe advised that consideration of them having other products to sell be- <br /> sides alcohol had not entered into discussions for off-sale licenses when decisions <br /> were made by a previous City Council as far as any precedence being set. <br /> Willmus moved, Laliberte seconded, authorizing the Roseville Police Department <br /> to issue and administer the presumptive penalty as set forth in Section 302.15 of <br />
