Consider Presumptive Penalty Approval — Cub Food Store Alcohol Compli- <br /> ance Failure <br /> Police Lt. Lorne Rosand reviewed the specifics of the Cub Food Store alcohol <br /> compliance failure at 2100 Snelling Avenue N, as detailed in the RCA dated Sep- <br /> tember 22, 2014. <br /> Having been notified of tonight's meeting by Lt. Rosand, no representatives were <br /> present, even though he had spoken to Mr. Ward Jackson who planned to be pre- <br /> sent and had been told to arrive earlier than indicated on the projected time on the <br /> agenda. <br /> Laliberte moved, Willmus seconded, authorizing the Roseville Police Department <br /> to issue and administer the presumptive penalty as set forth in Section 302.15 of <br /> Roseville City Code for an off-sale liquor license holder first violation within thir- <br /> ty-six months; with a mandatory minimum penalty of$1,000 fine and a zero-day <br /> license suspension; for alcohol compliance failure at Cub Food Store located at <br /> 2100 Snelling Avenue N. <br /> In addressing the $150 penalty for the server, Lt. Rosand advised that this had <br /> been an error on the part of the Police Department in their code book and cita- <br /> tions, and the other violators had paid the administrative fine of$250.00. If there <br /> is a failure to pay, Lt. Rosand noted the process was turned over to the City Attor- <br /> ney to proceed with charges for a gross misdemeanor for the server. <br /> Mayor Roe and Councilmember Laliberte agreed that the employee entering a <br /> false birth date on the computer was very egregious and troubling to them. <br /> Roll Call <br /> Ayes: Willmus, Laliberte and Roe. <br /> Nays: None. <br /> 14.
