<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 07/24/00 <br />ITEM NO: 1-5 <br /> <br /> <br />Manager Approved: <br />cb- <br />Request by Carlson-LaVine, Inc. to vacate a utility and drainage easement on <br />property located at 2965 Partridge Road. (PF3235) <br /> <br /> <br />Agenda Section: <br />LAND USE <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Carlson-LaVine, Inc. has requested the vacation of a 20-foot wide utility and drainage <br />easement that lies between Lot 3 and Lot 4, Block 1 Partridge Industrial Park, 2965 Partridge <br />Road. (legal description attached). <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Carlson-LaVine, Inc. has requesting the 20-foot wide utility and drainage easement be <br />vacated to allow them to construct an office, warehouse, and contractor storage facility on <br />the property. <br /> <br />2.2 The 20-foot wide utility and drainage easement was provided with the Partridge Industrial <br />Park plat. This easement, however, has never been used. <br /> <br />2.3 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. A public <br />hearing is required. The Planning Commission holds the hearing and recommends action on <br />the vacation request to the City Council. <br /> <br />3.0 STAFF COMMENTS <br /> <br />In reviewing this request, staff made the following findings: <br /> <br />3.1 The Roseville Engineering Department has reviewed its records and determined the easement <br />is no longer necessary. Further, the Engineering Department has determined that no utility <br />company is currently using the easement. <br /> <br />3.2 The property is surrounded with utility and drainage easements that are used to disburse city <br />and private utilities. <br /> <br />3.3 Carlson-LaVine owns two lots divided by the easement and needs the unused easement <br />vacated to develop the property. <br /> <br />3.4 The vacation will not require the relocating of any utility. <br /> <br />PF3235 - RCA (07/24/00) - Page 1 of 2 <br />
