<br />4.2 The hardship situation was (was not) created by the applicant (Bradley) or existed prior <br />to the applicant. . . <br /> <br />4.3 The unique physical features or situations within the proposal that could justify a <br />variance include ... <br /> <br />4.4 The economic issues that may (in part) justify a variance include... <br /> <br />4.5 The alternative designs that allow use of the site but do not require a variance include... <br /> <br />4.6 The impacts of the project, if the variance was issued, would (would not) create <br />significant community impacts on the health, safety, or general welfare including... <br /> <br />4.7 Other findings deemed appropriate by the Planing Commission... <br /> <br />Conditions of CUP approval: <br />4.8 Staff recommends attaching conditions to the CUP that minimize adjacent residential <br />impacts and limit future use of the property. <br /> <br />4.9 The parcel shall be limited to a rear yard lot coverage of 45% or 832 square feet. <br /> <br />4.10 The proposed detached accessory building and hard surface driveway expansion, if not <br />five feet from the property line, must either be relocated to the five foot side yard setback <br />or the applicant must apply for a setback permit. <br /> <br />4.11 All roof drainage created by the new structure must be collected in gutters and channeled <br />to the natural drainage way within the applicant's property. <br /> <br />4.12 The exterior ofthe building must be of similar materials and color of the home. <br /> <br />4.13 Because of the size of the new structure (832 s.f.) and lot coverage, no other accessory <br />building or tool shed may be permitted on the property. <br /> <br />4.14 The maximum height (as defined in Section 1004.01) shall be 15 feet, to the midpoint of <br />the roof, <br /> <br />4.15 The existing detached accessory structure must be razed and removed from the site. <br /> <br />4.16 Prior to issuance of a building permit, and within 60 days after approval of the <br />conditional use permit, the applicant must record the conditional use permit with the <br />Ramsey County Recorder. Ifnot recorded within 60 days from the approval date, the <br />conditional use permit and variance expires. However, the applicant can (within the 60 <br />days) apply for an extension. <br /> <br />4.17 This conditional use permit expires 6 months after approval if a building permit has not <br />been issued.
