(PF3237) <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Family Academy Charter School has submitted an application for an Interim Use Permit to <br />allow a temporary modular building (eight classrooms) in the east parking lot of Advent <br />Lutheran Church, 3000 Hamline Avenue for a period of three years. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Section 1012.09A states: the City Council may authorize an interim use permit of <br />property. Interim use may not be consistent with the land uses designated on the adopted <br />Land Use Plan. They may also fail to meet all of the zoning standards established for the <br />district within which it is located. <br /> <br />2.2 Section 1012.09B states: the City Council may attach conditions to interim use permits. <br />In reviewing interim use permit applications, the City will establish a specific date or <br />event that will terminate the use on the property. The Council will also determine that <br />the approval of the interim use would not result in adverse effects on the public health, <br />safety and general welfare, and that it will not impose additional costs on the public if it <br />is necessary for the public to take the property in the future. <br /> <br />2.3 For the past year Family Academy Charter School has been searching for a larger space to <br />operate their Kindergarten through Grade 8 school. Recently Family Academy struck and <br />agreement with Advent Lutheran Church to rent space within the church complex. However, <br />the needs of Family Academy are slightly greater than the space they are renting and require <br />an eight classroom modular structure. <br /> <br />2.4 Advent Lutheran Church is currently home to the Metro Music School and the <br />YamahalSuzuki Music Schools. <br /> <br />2.5 Advent Lutheran Church has an approximate sanctuary seating capacity of 500 seats. This <br />size of an assembly area has a parking requirement of 143 off-street parking spaces.
