DNR Waters has reviewed the August 8, <br />2000 letter and the plans that were submitted with the letter, and DNR Waters would object to the approval <br />of the variance request as proposed for the following reasons: <br /> <br />1. Generally, one of the requirements for the approval of a variance is that there should be no other <br />alternatives available for the project. However, it appears that there is an alternative location for <br />the Mickelson garage that would require a much smaller variance ftom the Shoreland Management <br />Ordinance. We recommend that the proposed garage be moved south along the property line <br />towards the existing home. This new location will conform with the DNR recommendation that <br />the designs of new structures be changed to conform to City Laws, instead of waiving City Laws <br />to conform to the plans for structures. Therefore, the City ofRoseville and Mr. Mickelson should <br />work together to fmd a more suitable location for the garage. <br /> <br />2. Generally, variances are issued when a hardship exists for the property. Due to the fact that the <br />garage might also be redesigned to fit within the lot area outside of the setback ftom Lake <br />Josephine, it appears that a hardship does not exist for the property. It should also be kept in mind <br />that some lots are not suitable for any new construction. <br /> <br />We recommend that the City ofRoseville and Mr. Mickelson investigate alternative designs and locations <br />for the proposed garage. The DNR is willing to participate in these meetings should the City ofRoseville <br />request our presence at the meeting. In addition, once the garage has been built, the City of Roseville <br />should require Mr. Mickelson to plant trees between the new garage and lake in order to screen the garage <br />from view from Lake Josephine. <br /> <br />Thank you for giving the DNR the opportunity to comment on the Mickelson variance. We look forward <br />to receiving a written record of the decision that is made on the request.
