<br />3.4 The structure at 353 South Owasso Boulevard is a rambler, most likely developed initially as a <br />cabin. It is located on a platted lot of record (Lake Owasso Villa, Lot 2) and was constructed in <br />1934. Permits were issued in 1961 for sanitary sewer and plumbing, and in 1964 for municipal <br />water and a foundation/basement. <br /> <br />3.5 The parcel lies approximately eight feet lower than the roadway and the lot slopes from a high <br />point at the road approximately 20 feet to the lakeshore. The parcel is long and narrow and has <br />topographical challenges such as access, slope, and mature trees. The existing structure is <br />aging and does not meet current building code standards and the parcel does not meet a number <br />of zoning requirements. <br /> <br />3.6 The Witt request was forwarded to the Department of Natural Resources (DNR) for review and <br />comment. The DNR has indicated support for the redevelopment of the parcel and <br />concluded that the difficult site has certain hardships that warrant variances. Their letter <br />to the City regarding the proposal is attached and requests that two conditions be included in <br />any approved variance. Specifically, the DNR requests that trees be planted between Lake <br />Owasso and the new home to screen the structure from view of the lake and that the lowest <br />floor elevation be at least one foot higher than the flood elevation of the lake. <br /> <br />4.0 POLICY & FISCAL IMPLICATION <br /> <br />4.1 The Comprehensive Plan and the Roseville Housing Improvement Plan encourage maintaining <br />and improving residential properties and infrastructure, as well as reconstruction and rebuilding <br />of residential structures ( and neighborhoods) throughout the community. <br /> <br />4.2 There are no additional fiscal implications. <br /> <br />5.0 ST AFF DETERMINED FINDINGS <br /> <br />5.1 Staff has reviewed the merits of the four variances necessary to allow Mr. Witt to proceed with <br />his proposed redevelopment plans. Staff offers the following findings: <br /> <br />a. Mr. Witt did not create the hardship. The lot division occurred and the structure was <br />constructed and improved many years before the Witt's purchased the property. City <br />records indicate the existing structure was constructed in 1934 with sewer, water, <br />foundation and a basement being installed in the early 1960's. The Roseville City Code <br />was adopted in 1959 and the Shoreland Ordinance adopted in 1974. <br /> <br />b. The economics of constructing an addition and remodeling versus constructing new are <br />quite different. The existing structure does not meet most building codes. In so doing, <br />there would be a need to gut the structure and start over. New construction can be <br />justified by providing a modern structure that meets all current building codes and the <br />purpose and intent of the Roseville Comprehensive Plan. <br /> <br />PF3279 - RCA (021201) Page 3 of5 <br />
