<br />c. Requiring a setback of75 feet from the OHW would be overly restrictive and out of <br />character with the adjacent homes. The parcel has a sharp (vertical) transition from the <br />road inward creating a unique physical feature that provides difficulties for <br />redevelopment and direct access. Access is currently (will remain) via a private <br />easement with the west property owner. The narrow width of the parcel limits the type, <br />style, and design options for a new home. Adjacent homes are located 38 feet (east) <br />and 60 feet (west) from the OHW suggesting the Witt home to be placed 49 feet (the <br />average of adjacent lots) from the OHW and in a similar line to the lakeshore. <br /> <br />d. Given existing conditions (parcel depth, width, and slope), the proximity of adjacent <br />structures from Lake Owasso, limited structure design options, and a requirement to <br />meet current side yard setbacks, there appears to be no alternative site designs that <br />would allow Mr. Witt to comply with the City Code and eliminate the need for <br />vanances. <br /> <br />e. The impacts of this redevelopment project, if the variances were issued, will not create <br />any significant community impacts on the health, safety, or general welfare. To the <br />contrary, the proposal removes a dilapidating structure (modified cabin) that is in dire <br />need of improvement and provides added value to the neighborhood. <br /> <br />6.0 PLANNING COMMISSION CONSIDERATION <br /> <br />6.1 On January 10, 2001, the Roseville Planning Commission held a public hearing regarding the <br />Witt request. At the meeting no adjacent residents were present to speak on the subject. Mr. <br />Witt was present to answer questions from the Planning Commission. <br /> <br />6.2 The Planning Commission was concerned with the access and the exterior of the salvaged <br />garage. In answer to their concern, Mr. Witt indicated that he would seek the proper <br />agreement/easement from his neighbor and that the existing salvaged detached garage would be <br />resided to match the new home. <br /> <br />6.3 The Planning Commission voted (5-0) to recommend approval of the Witt request for multiple <br />variances necessary to reconstruct the home at 353 South Owasso Boulevard, based on the <br />findings in Section 5 (see attached resolution) and subject to the following conditions: <br /> <br />A. The redeveloped principal structure (home and attached garage) shall be limited to <br />2,204 square feet with a full basement. <br /> <br />B. The proposed principal structure shall be set back a minimum of five feet from the east <br />and west property lines. <br /> <br />C. The proposed principal structure shall be setback a minimum of 48 feet from the <br />Ordinary High Watermark of Lake Owasso. <br /> <br />D.
