Regular Planning Commission Meeting <br />Minutes – Wednesday, November 07, 2012 <br />Page 2 <br />Chuck Plowe, Applicant Representative <br />42 <br />Mr. Plowe was present in the audience; however, he had no additional comments beyond <br />43 <br />concurring with staff’s presentation. <br />44 <br />Chair Boerigter closed the Public Hearing for File 07-006 at approximately 6:37p.m.; with <br />45 <br />no one appearing for or against. <br />46 <br />MOTION <br />47 <br />Member Boguszewski moved, seconded by Member Boerigter to recommend to <br />48 <br />the City Council APPROVAL of a VACATION of the drainage easement; based on <br />49 <br />the comments and findings of Sections 4-6 and the recommendation of Section 7 <br />50 <br />of the staff report dated November 7, 2012 <br />51 <br />Ayes: 4 <br />52 <br />Nays: 0 <br />53 <br />Motion carried. <br />54 <br />Anticipated City Council action is scheduled for November 19, 2012. <br />55 <br />b. PROJECT FILE 0003 <br />56 <br />Request by the Planning Division for approval of a ZONING TEXT CHANGE to <br />57 <br />repeal the entirety of the invalidated Twin Lakes Overlay District – Chapter 1022 of <br />58 <br />the Roseville Zoning Ordinance <br />59 <br />Chair Boerigter opened the Public Hearing for Project File 0003 at approximately 6:38 <br />60 <br />p.m. <br />61 <br />City Planner Thomas Paschke briefly reviewed the background of the Twin Lakes <br />62 <br />Overlay District, and subsequent court finding that it was invalid and unenforceable; as <br />63 <br />detailed in the staff report dated November 7, 2012. <br />64 <br />Chair Boerigter noted that Section 1.1 of the staff report had an error in the date of <br />65 <br />Ordinance 1417 adoption, correcting it from 2012 to 2011. <br />66 <br />Chair Boerigter closed the Public Hearing for File 003 at approximately 6:40 p.m.; with no <br />67 <br />one appearing for or against. <br />68 <br />MOTION <br />69 <br />Member Olsen moved, seconded by Member Boerigter to recommend to the City <br />70 <br />Council APPROVAL of the request to eliminate in its entirety Chapter 1022 or the <br />71 <br />Zoning Ordinance regarding Overlay district Twin Lakes. <br />72 <br />Ayes: 4 <br />73 <br />Nays: 0 <br />74 <br />Motion carried. <br />75 <br />c. PLANNING FILE 0017 <br />76 <br />Request by the Planning Division for approval of a ZONING TEXT CHANGE to <br />77 <br />several sections of City Code Title 10 (Zoning) for the correction of typographical <br />78 <br />and punctuation errors <br />79 <br />Chair Boerigter opened the Public Hearing for File 0017 at approximately 6:41 p.m. <br />80 <br />Associate Planner Bryan Lloyd briefly reviewed the request to correct simple errors in <br />81 <br />syntax, organization, and punctuation based on day-to-day use of the Zoning Code; as <br />82 <br />detailed in the staff report dated November 7, 2012. <br />83 <br />Chair Boerigter closed the Public Hearing for File 0017 at approximately 6:43 p.m.; with <br />84 <br />no one appearing for or against. <br />85 <br />MOTION <br />86 <br />Member Boerigter moved, seconded by Member Gisselquist to recommend to the <br />87 <br />City Council APPROVAL of the ZONING TEXT CHANGE as presented; based on the <br />88 <br />comments and findings of Sections 4-6 and the recommendation of Section 7 of <br />89 <br />the staff report dated November 6, 2012. <br />90 <br /> <br />
