Regular Planning Commission Meeting <br />Minutes – Wednesday, August 7, 2013 <br />Page 6 <br />Acting Chair Cunningham advised that she had some reservations with the application, <br />244 <br />specifically based on the 6’ to 30’ requirement; she expressed hope that the applicant would <br />245 <br />continue to consult with neighbors to address their concerns. Since the Commission was asked to <br />246 <br />vote on this specific item and its proposed location, Acting Chair Cunningham spoke in support of <br />247 <br />the application based on staff’s recommendation. <br />248 <br />MOTION <br />249 <br />Member Daire moved, seconded by Member Murphy to recommend to the City Council <br />250 <br />APPROVAL of the INTERIM USE at 2131 Fairview Avenue; based on the comments and <br />251 <br />findings of Sections 4 – 6 and the recommendation of Section 7 of the staff report dated <br />252 <br />August 7, 2013. <br />253 <br />Ayes: 5 <br />254 <br />Nays: 0 <br />255 <br />Motion carried. <br />256 <br />While Council action related to this action was originally anticipated at their August 26, 2013 <br />257 <br />meeting; Mr. Lloyd advised that he heard that it may be rescheduled for their August 19, 2013 <br />258 <br />meeting. <br />259 <br />6. Other Business <br />260 <br />Review a proposed City acquisition of land adjacent to Langton Lake Park <br />261 <br />Parks & Recreation Director Lonnie Brokke was available for this discussion. <br />262 <br />While Acting Chair Cunningham opened the Public Hearing on this item at approximately 7:17 <br />263 <br />p.m., Mr. Lloyd clarified that, while any interested members of the public were encouraged to <br />264 <br />comment, this was not actually a Public Hearing. Mr. Lloyd advised that instead it was a <br />265 <br />statutorily-mandated review by the Commission of any land acquisition by a City. Mr. Lloyd <br />266 <br />displayed and reviewed the Site Plan identifying the subject property. Mr. Lloyd advised that, <br />267 <br />while the parcel had previously been owned by a city resident, and sold in the 1980’s to the <br />268 <br />current property owner (Roseville Properties) was currently in negotiation with the City for <br />269 <br />purchase of the property. Mr. Lloyd noted that acquisition of the parcel would allow a westward <br />270 <br />expansion of Langton Lake Park. <br />271 <br />As detailed in the staff report dated August 7, 2013, Mr. Lloyd identified goals and policies of the <br />272 <br />Comprehensive Plan and Parks & Recreation System Master Plan (Section 2 of the staff report) <br />273 <br />specific to this acquisition. <br />274 <br />Discussion with members included current zoning (Community Mixed Use-CMU) consistent with <br />275 <br />other privately-owned parcels adjacent to Langton Lake Park; how the property’s zoning <br />276 <br />designation would be transitioned in the future (e.g. Park/Open Space) or remain CMU which <br />277 <br />allowed for park, open space and recreation type uses and could remain designated CMU unless <br />278 <br />the City chose to change that designation if the property acquisition was successful; and noting <br />279 <br />that the remaining parcel on the west side continuing under CMU designation and not providing <br />280 <br />much opportunity for redevelopment, with staff noting that the parcel identified was not under the <br />281 <br />same ownership as this parcel and not part of present negotiations. <br />282 <br />Further clarification by staff on the CMU designation in the Comprehensive Plan and Zoning <br />283 <br />Code identified “other civic and institutional uses,” not specifically identified as park land; and <br />284 <br />requiring a closer look by staff at definitions for those uses that had a typically park/recreation <br />285 <br />component (e.g. school use). <br />286 <br />At the request of Member Daire, Mr. Lloyd advised that the City’s proposed use of the space was <br />287 <br />passive and as an expansion of adjacent Open Space. <br />288 <br />At the request of Member Daire, Mr. Lloyd advised that he was not aware of what prompted this <br />289 <br />request; but noted that from a Parks & Recreation standpoint, it was a desirable transition to <br />290 <br />further protect Langton Lake Park. Mr. Lloyd noted that the City’s regulating plan and zoning code <br />291 <br />had designated that area for public use; and further noted that restricted uses of the subject <br />292 <br />parcel made it difficult for the present owner to consider any actual development or provide a <br />293 <br />profitable use for the parcel. <br />294 <br /> <br />
