You have posed the following hypothetical situation: <br /> <br />. The proposed project exceeds the mandatory EA W threshold <br /> <br />. The EA W is prepared and a negative declaration is issued <br /> <br />. All other permits and approvals necessary for the construction of the project to <br />proceed are obtained <br /> <br />. Before any construction begins, the proposer proposes to add space to the project <br /> <br />. The additional space: <br />. By itself does not meet the mandatory EA W threshold <br />. If added to the initial project (for which the negative declaration was issued), the <br />total project would exceed the mandatory EIS threshold. <br /> <br />My interpretation of part 4410.4300, subp. 1 is that once a negative declaration is issued <br />for a project, that project may not be included when determining if a proposed expansion <br />or addition meets or exceeds a threshold.
