Planning File 3639: Request by Daniel Smith (Dairy Queen), 3070 <br />1 <br />Lexington Avenue, for a Variance to Section 1009 of the Roseville City <br />2 <br />Code to relocate a pylon sign to within one foot of the property line <br />3 <br />adjacent to Lexington Avenue. <br />4 <br />5 <br />6 Chair Bakeman opened the hearing and requested staff to provide a verbal summary of <br />7 the report dated May 4, 2005. <br />8 <br />9 Thomas Paschke explained that Daniel Smith of SDDQ (Dairy Queen) seeks approval of <br />10 a 29 foot Variance to Section 1005.01 to allow the relocation of an existing pylon sign to <br />11 within one foot of the property line adjacent to Lexington Avenue. The applicant <br />12 proposes to locate the sign one foot from the wet property line, similar to those sign <br />13 variances approved at the B-Dale Club, Brentwood Town Offices and Kinderberry Hill <br />14 Child Care. <br />15 <br /> <br />16 The Staff recommended approval of an29 foot variance to Section 1005.01 (Business <br /> <br />17 District – Minimal Dimensional Requirements)of the Roseville City Code to allow the <br />18 relocation of a legal conforming pylon sign to no closer than one foot from the property <br />19 line adjacent to Lexington Avenue (west) based on the findings in Section 5 of the project <br />20 report dated May 4, 2005, and the following conditions: <br />21 <br />22 a. The edge of the pylon sign (not the pylon post) must be set back a <br />23 minimum of 1 foot from the property line adjacent to Lexington Avenue. <br />24 b. The pylon sign height must be limited to a maximum height of 20 feet <br />25 above grade. <br />26 c. The applicant must locate and expose the property corner markers adjacent <br />27 to Lexington Avenue, prior to the issuance of a sign permit. <br />28 d. The pylon sign must be internally lit (as currently designed) and externally <br />29 lit which source may be visible from Lexington Avenue and the adjacent <br />30 residential properties. <br />31 e. The sign base (ground) must include some landscaping, including low <br />32 growing shrubs and perennials. <br />33 f. The variance (if granted) shall expire within 6 months of its approval if a <br />34 sign permit is not issued (Section 1013.03). <br />35 <br />36 Chair Bakeman asked if the adjoining (south property line) spotlight was in the right-of- <br />37 way. Member Doherty asked the distance of movement from the current location to the <br />38 new proposed location (approximately 25 feet). Member Boerigter asked if a variance is <br />39 approved, will the inspection department will verify location and setback. (The inspector <br />40 will field inspect the setback). <br />41 <br />42 Dan Smith explained he had no questions with the staff report. The post light (south <br />43 property line0 would be moved to light the parking lot instead of the sign. <br />44 <br />45 Marian Hewitt, 3076 North Lexington, explained it was hard to see cars coming down <br />46 Lexington.
