5. Public Hearing: <br />1 <br />2 <br /> <br />a.Planning File 3668:Request by Benjamin Levitz for a Variance to <br />3 <br />Section 1012.02B2 of the Roseville City Code to allow the construction <br />4 <br />of a five foot tall fence in portion of the front yard of property at 1465 <br />5 <br />Roselawn Avenue. <br />6 <br /> <br />7 <br />8 Chair Bakeman opened the hearing and requested staff provide a verbal summary of the <br />9 project report dated September 7, 2005. <br />10 <br />11 City Planner, Thomas Paschke, advised that Benjamin Levitz seeks approval of a 1 foot <br />12 fence height Variance to Section 1012.02B2 of the Roseville City Code to allow the <br />13 installation of a 1 foot lattice for privacy thereby creating a 5 foot tall fence in his front <br />14 yard, located at 1456 Roselawn Avenue. He explained the layout of the fence. <br />15 <br />16 Member Pust entered the meeting. <br />17 <br />18 City staff recommends approval of the one foot Variance to Section 1012.02B2 of the <br />19 Roseville City Code for Benjamin Levitz, 1465 Roselawn Avenue, based on the findings <br />20 in Section 5 and the following conditions: <br />21 <br /> <br />a. <br />22 The fence must not exceed a height of 5 feet measured from the existing <br />23 grade to top of fence\\lattice. <br />24 <br /> <br />b. <br />25 The fence extension must be constructed of with a wood lattice design. <br />26 <br /> <br />c. <br />27 The variance shall expire within six months after the approval date <br />28 (September 7, 2005) unless that applicant has been granted a building <br />29 permit. <br />30 <br />31 <br />Chair Bakeman asked for details of other fences along Roselawn. She asked if landscaping of <br />32 <br />similar nature could be placed in front of the fence. Such fences are more attractive, but <br />33 <br />must adhere to sight line safety issues. There were no further comments. <br />34 <br /> <br />35 <br />Chair Bakeman closed the hearing. <br />36 <br /> <br />d.Motion: <br />37 Member Boerigter moved, seconded by Member Bakeman to <br />38 adopt a Resolution approving a one foot front yard Variance to Section <br />39 1012.02B2 of the Roseville City Code for Benjamin Levitz, 1465 <br />40 Roselawn Avenue, based on the findings in Section 5 and the conditions <br />41 of Section 6 of the project report dated September 7, 2005, and with the <br />42 correction to condition “b” for clarity as follows: “The fence extension <br />43 must be constructed of with a wood lattice design”. <br />44 Ayes: 3 <br />45 Nays: 0 <br />46 Motion carried. <br />Page 2 of 4 <br /> <br />
