REQUEST FOR COUNCIL ACTION <br /> Date: 10-27-14 <br /> Item No.: <br />13.a <br />Department Approval City Manager Approval <br />Community Development Department’s Request to Issue a Ramsey County <br />Item Description: <br />Court Citation for an Unresolved Violation of Roseville’s City Code at 2026 <br />Asbury Street <br />B <br />ACKGROUND <br />1 <br />2026 Asbury Street is a single-family home located in a residential neighborhood. Records indicate the <br />2 <br />property is owned by Ms. Grace Mwassa. <br />3 <br />Last winter, Police were called to this property, at which time Ms. Mwassa was transported to a <br />4 <br />relative’s home because the home’s furnace was inoperable and the home cold. Ms. Mwassa was given <br />5 <br />10 days to repair the furnace or the home would be condemned (per City Code Section 906.03.H: <br />6 <br />Unsafe Structure and Equipment). The furnace was not repaired. Staff has been told there is no <br />7 <br />financial assistance available to the homeowner because the home is currently in foreclosure. <br />8 <br />Due to the non-functional furnace, the house was condemned, meaning it could not be reoccupied until <br />9 <br />repairs are completed. However, the property owner then reoccupied the home in violation of the <br />10 <br />condemnation order. <br />11 <br />Follow-up inspections this summer revealed the home is also without gas service (per Xcel) and <br />12 <br />electricity (per Xcel). Following another welfare check in September, Ramsey County Human Services <br />13 <br />obtained alternative housing for Ms. Mwassa. At this time the City shut off water service to the home <br />14 <br />(it potentially has damage to water lines from last winter). Ms. Mwassa then refused the alternative <br />15 <br />housing, leaving it and again re-occupied the home. <br />16 <br />Staff has been inside the home and has observed that it does not appear to be a health risk to the <br />17 <br />community. Supposedly Ms. Mwassa is bathing at a relative’s home. <br />18 <br />While presently not a health risk, the home does not have: a functioning furnace, gas service, electrical <br />19 <br />service or water service. These conditions are violations of City Code Section 906.03.H. (Unsafe <br />20 <br />Structure and Equipment) of Roseville’s Building Maintenance and Preservation Code. <br />21 <br />Staff is requesting authority to issue a Ramsey County Court Citation in order to require that the home <br />22 <br />be vacated until it has been repaired and services restored. A Ramsey County court date would allow <br />23 <br />Ms. Mwassa due process before being required to vacate the property. <br />24 <br />25 <br />26 <br />27 <br />28 <br />Page 1 of 2 <br />
