<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: 02/26/01 <br />ITEM NO: C-l <br /> <br />Manager Approved: Agenda Section: <br />t CONSENT <br /> <br />A request by James Kueffer for a Minor Subdivision (Correction) to modify <br />an existing property line between Lots 4 and 5, Franksons Garden Plateau, <br />Block 2, 896 Parker Avenue (PF3289). <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Mr. James Kueffer, property owner at 896 Parker Avenue has requested the City Council <br />approval of a "Correction" to a common lot line between two lots in Roseville. <br /> <br />1.2 Section 11 04.04D specifies the procedures for consideration and approval of a <br />"Correction." Specifically, this section of the City Code states: "Corrections: When a <br />surveyor description of a parcel or lot has been found to be inadequate to describe the <br />actual boundaries, approval of a corrective subdivision may be requested. This type of <br />subdivision creates no new lots or streets. The proposed corrective subdivision, in sketch <br />plan form, along with a letter signed by all affected owners agreeing to the new <br />subdivision, shall be submitted to the City Council for approval. No hearing or Planning <br />Commission review is necessary unless the proposal is referred to the Commission by the <br />Community Development Director for clarification. The proposed parcels shall not cause <br />any portion of the existing lots, parcels, or existing buildings to be in violation of this <br />regulation or the zoning code. A certificate of survey illustrating the corrected boundaries <br />shall be required on all parcels. Within thirty (30) days after approval by the City <br />Council, the applicant shall supply the final survey to the Community Development <br />Director and City Manager for review and approval. After completion of the review and <br />approval by the Community Development Director and City Manager, the survey shall be <br />recorded by the applicant with the Ramsey County Recorder within sixty (60) days. <br />Failure to record the subdivision within sixty (60) days shall nullify the approval of the <br />subdivision. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Staff has worked with Mr. Kueffer on his proposal to modify the interior lot line between <br />Lot 4 & Lot 5, Block 2, Franksons Garden Plateau. <br /> <br />2.2 Staff has reviewed the attached sketch plan for the proposed correction and concluded <br />that the lot line modification will need to meet all applicable zoning ordinance <br />requirements.
