<br />REQUEST FOR PLANNING COMMISSION ACTION <br /> <br />Department Approval: <br /> <br />DATE: 03/26/01 <br />ITEM NO: :E 1 <br /> <br />Agenda Section: <br />LAND USE <br /> <br />A request by Cave & Associates, L TD to amend the Comprehensive Land <br />Use Designation of vacant property located at 197 County Road B-2 from <br />"B" Business to "HR" High Density Residence and to rezone from B-2, <br />Retail Business District to R-3A, Multi-Family Residential District; Three <br />to Twenty Four Units (PF3293). <br /> <br />Manager <br /> <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />Cave & Associates have requested approval of a Comprehensive Land Use Plan Amendment <br />from "B" Business to <<HR" High Density Residence and approval of a rezoning from B-2, Retail <br />Business District to R-3A, Multi-Family Residential District; Three to Twenty Four Units. The <br />applicant proposes developing the parcel into an 18-unit apartment complex. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 The property at 197 County Road B-2 has long been a vacant undeveloped parcel, and <br />given the wetland to the north, a difficult property to develop. The site was originally a <br />portion of a lot facing Rice Street that subsequently was divided and developed. The lot <br />was filled. The development proposal by Cave & Associates is for a two-story 18-unit <br />apartment complex with underground parking. <br /> <br />2.2 Section 1015.01 to 1015.03 specifies the procedures for considering a property rezoning. <br /> <br />3.0 PROJECT REVIEW <br /> <br />3.1 Cave & Associates propose to develop the 171-foot by 362-foot (1.42 acre or 61,900 s.f.) <br />parcel into a two-story 18-unit apartment complex with 16 surface parking spaces and 21 <br />underground parking spaces. The property at 197 County Road B-2 lies in <br />Comprehensive Planning District 6 and has a Future Land Use designation of"B" <br />Business. The current zoning of the parcel is B-2, Retail Business District. While the <br />Zoning Ordinance allows apartments in a B-1, Limited Business District by conditional <br />use pennit, multi-family uses are not allowed in other business districts. However, the <br />Community Development Department staff had detennined for clarity and consistency, <br />the most appropriate action is to use a Comprehensive Land Use Plan Amendment to <br />High Density Residential and a rezoning to R-3A, Multi-Family Residence District; <br />Three to Twenty Four Units. <br /> <br />PF3293 - RCA 032601 Page lof8 <br />
