<br />Site #MIN544 I <br /> <br />LEASE AGREEMENT <br /> <br />This Lease Agreement ("Lease") is entered into this _ day of January <br />2001, by and between the City of Roseville, a Minnesota municipal corporation <br />("Owner" or "Lessor") and CellularQwest Wireless, L.L.c., a <br />Delaware limited liability company corpor~',tion (" Owest"), with local <br />offices at __________________________ 426 North Fairview A venue, Suite 10 L St. Paul, MN 55104 <br />("Lessee"). <br /> <br />Recital <br /> <br />The Lessor is the owner of a certain parcel of property lying within the City of Roseville, <br />County of Ramsey, State of Minnesota. which is more pat1icularlv described on Exhibit "A". <br /> <br />It is the intention of the parties that the Lessee lease~ one particular site on the parcel and <br />construct a communications antenna tower and certain accessory buildings to the <br />communications antenna tower. which is more particularl\' described on Exhibit "]3" ("Leased <br />Premises"). The entire constructions costs shall be the respsonsibilityresponsibility of the <br />Lessee. The Lease will run for ten (10) years with two (2) ten (10) year extensions at the option <br />of the Lessee. <br /> <br />The Lessee will build the communications antenna tower with <br />anntenaantenna mounting sectors to accommodate at least one other wireless carrier including <br />the Lessee and Lessor. <br /> <br />In consideration of the terms and conditions of this Agreement, the parties agree as <br />follows: <br /> <br />1. The Property. Lessor is the record owner of a certain parcel of real property located <br />in the State of Minnesota, County of Ramsey, City of Roseville, commonly known as Roseville <br />Fire Station #3 (the Property). A legal description of the Property is contained <br />in Exhibit ~A: to this Lease. <br /> <br />2,.2. Leased Premises. Owner hereby leases to Lessee that portion of the Property ("the Leased <br />PremisiesPremises") upon which Lessee shall construct certain communications facilities <br />consisitingconsisting of a self-supporting monopole anntenaantenna communications tower <br />approximately eighty five (85') sixtv (60') fee! in height with sufficient mounting sectors to <br /> <br />83831 <br /> <br />1 <br />
