facsimile with Owner's Contact Person shall in no wav satisfy the notice requirements set forth in other provisions of this Lease, unless thosc provisions cxpressly allow verbal or facsimile notification as an acceptable mcans of fulfilling Lessee's notification obligation. 19. Representations and Warranties. (a) Owner represents that (il) it has full right, power, and authority to execute this Lease and~ (ii) it has good and unencumbered title to the Property free and clear of any liens or mortgages. Owner warrants that Lessee shall have quiet enjoyment of the Property during the term of this Lease in accordance with its terms. (b) Lessee represents and warrants that its use of the Premises, herein, will not generate and it will not store or dispose on the Property nor transport to or over the Property any hazardous substance-,- aHEl-Lessee further agrees to hold Owner harmless from and indemnify Owner against aB:y-the release of any such hazardous substance and any damage, loss, or expense or liability resulting from the breach of this representation or from the violation of any state or federal law by such release Lessee, including all attorneys' fees, costs and penalties incurred as a result thereof except any release caused by the negligence of O't'mer, its employees or Gf;ents, other than such materials used in the ordinance course of .J.1essee's 's wireless telecommunications business in accordance with all applicable Laws and Regulations. "Hazardous substance" shall be interpreted broadly to mean any substance or material defined or designated as hazardous or toxic waste, hazardous or toxic materials, hazardous or toxic or radioactive substance, or other similar term by any federal, state or local environmental law, regulation or rule presently in effect or promulgated in the future, as such laws, regulations or rules may be amended from time to time; and it shall be interpreted to include, but not be limited to, any substance which after release into the environment will or may reasonably be anticipated to cause sickness, death or disease. Notwithstanding anything to the contrary contained in this Lease, Owner agrees that Lessee may use or store sealed batteries and/or generators on the Site for use in connection with Lcssec's Communications Facilities, together with small amounts of customary cleaning supplies, all handled in accordance \vith all applicable laws. (c) Owner represents that Owner has no knowledge of any substance, chemical, or waste on the Owner's Property that is identified as hazardous, toxic or dangerous in any applicable federal, state or local law or regulation. 20. Successors and Assigns. This Lease shall run with the Property. This Lease shall be binding upon and inure to the benefit of the parties, their respective successors, personal representatives and assigns. 21. Miscellaneous. (a) Each party agrees to furnish to the other, within teH-thirty (30-1:4) days after request, such truthful estoppel information as the other may reasonably request. 83831 9
