<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />. <br /> <br /> <br />Item Descnption: <br /> <br />DATE: 06/26/01 <br />ITEM NO: c-:., <br /> <br />Manager Approved: ~ I/J Agenda Section: <br />{ (J CONSENT <br />A request by Steven Marchek for an 18-foot Variance from Section 703.04B4 of the <br />Roseville City Code for property located at 2995 West Owasso Boulevard (PF3306) <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Steven Marchek is requesting an I8-foot variance from Section 703.04B4 ofthe City Code to <br />allow a driveway apron (in the public right-of-way) to be within the required setback from a street <br />comer property line. Mr. Marchek's current driveway is located 12 feet from the property line <br />adjacent to Brenner A venue and the Code requires a setback of 30 feet. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Mr. Marchek owns the property located at 2995 West Owasso Boulevard. The property is zoned <br />R-I, Single Family Residential, and the Comprehensive Plan identifies the property as Low <br />Density Residential. <br /> <br />2.2 <br /> <br />The City's Pavement Management Program and the reconstruction of West Owasso Boulevard <br />have prompted the variance request. <br /> <br />. <br /> <br />2.3 The proposed reduction of this setback will enable Mr. Marchek to retain his driveway in its <br />current location. <br /> <br />DRIVEWAY SETBACK <br />CORNER LOT <br />Code Re uirement <br />30 feet <br /> <br />Current Setback A <br />12 feet <br /> <br /> <br />Variance Re uested <br />18 feet <br /> <br />3.0 STAFF COMMENT & FINDINGS <br /> <br />3.1 Section 703.04B(4) requires a maximum driveway setback of30 feet from a property line (comer <br />lot) adjacent to a street right-of-way. Based on the proposal a variance is necessary to allow the <br />existing driveway to remain. <br /> <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that <br />no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.3 <br /> <br />Variances may be granted where the strict enforcement of the literal provisions of the ordinance <br />would cause "undue hardship". The granting of a variance shall only occur when it can be <br />demonstrated that such an action will be in keeping with the spirit and intent of the ordinance. <br /> <br />. <br /> <br />PF3306 RCA (062601) Page lof2 <br />
