Plannine: File 3309: Olson request for a 19 foot Variance from Section <br />4 703.04Bla and a five foot Variance from Section 703.04B9 for property at <br />5 3188 West Owasso Boulevard. (Wm Olson) <br />6 <br />7 Chair Rhody opened the hearing and requested Thomas Paschke to provide a verbal <br />8 summary of the staff report dated June 12,2001. <br />9 <br />10 William Olson is requesting a 19-foot variance from Section 703.04Bla of the City <br />11 Code to allow a driveway apron in the public right-of-way to be increased from the <br />12 required 26-foot maximum width to a width of 45 feet. Mr. Olson is also seeking a <br />13 variance from Section 703.04B9 of the Roseville City Code to allow a driveway to <br />14 encroach into the required five foot setback five feet. <br />15 <br />16 With this reduction of setback, Mr. Olson may retain the driveway in approximately <br />17 the same location. <br />18 <br />19 The three findings recommended by the staff included: <br />20 <br />21 J. The property in question cannot be put to a reasonable use if used under conditions <br />22 allowed by the official controls: Mr. Zaun currently has a 32-foot wide apron that <br />23 provides access to the detached garage (directly adjacent to West Owasso Boulevard) and <br />24 driveway that extends towards the home which provides access and parking. Requiring <br />25 an apron modification consistent with the City Code (26 feet in width) would <br />26 prevent/critically limit access to the home and off-street parking. <br />27 <br />28 K. The plight of the land owner is due to circumstances unique to the property not created <br />29 by the land owner: The City's Pavement Management Program and the reconstruction of <br />30 West Owasso Boulevard has required Mr. Zaun to apply for a variance ifhe wants the <br />31 existing (or similar) driveway apron width to remain. Mr. Zaun's driveway <br />32 improvements were constructed prior to the City having a maximum apron width <br />33 requirement for the public right-of-way. <br />34 <br />35 L. The variance, if granted, will not alter the essential character of the locality: The <br />36 proposed six-foot variance to the required apron width in a public right-of-way will not <br />37 alter the essential character or the locality, nor adversely affect the public health, safety, <br />38 or general welfare, of the city or adjacent properties. <br />39 <br />40 Staff recommended approval of the two variances. <br />41 <br />42 Deb Bloom, Assistant Public Works Director, noted that the driveway is <br />43 approximately a 20% grade. <br />44 <br />45 Member Wilke asked if drainage on driveway will remain in the street (The grade <br />46 difference in the new road design will reduce street-to-drive drainage). <br />47 <br />
