<br />REQUEST FOR PLANNING COMMISSION ACTION <br /> <br /> <br />DATE: 08/08/01 <br />ITEM NO: 4b <br /> <br />Agenda Section: <br />PUBLIC HEARING <br /> <br />A request by Kathleen Agness (Schorn Realty) for a Comprehensive Land <br />Use Plan Amendment and Rezoning of property located at 2256 <br />Lexington Avenue (PF3329) <br /> <br />Manager Approved: <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Kathleen Agness has requested a Comprehensive Plan Amendment from Low Density <br />Residential (LDR) to Business (B) and a Rezoning from Single Family Residence <br />District (R-l) to Limited Business District (B-1) on the property located at 2256 <br />Lexington Avenue. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 The 20,271 s.f. property located at 2256 Lexington A venue was formerly the Rymer <br />School of Fine Arts Academy, a use that existed on the property for approximately 40 <br />years. The building is estimated to be 4,000 s.f. in size. Parking number and coverage on <br />the site is unknown at this time. <br /> <br />2.2 The buyer/seller assumes that a special use permit was issued to the Rymer Academy that <br />it could apply to Schorn Realty. The City has no record of a special use permit for <br />anything but the Rymer Music Academv. A Music School (or school) is a permitted <br />use in the current R-l low density residential zoning district text; a business is not <br />permitted. <br /> <br />2.3 After Schorn Realty occupied the property, the Community Development Department <br />became aware of the inconsistent use through an inspection of the premises for signs <br />being installed without a permit and not in accordance with the City Code. One of the <br />owners also called asking for details of how to obtain a permit to pave the front yard for <br />parking. The staff also received phone calls asking how the office had been approved on <br />that site. Staff informed the owners that the use was not permitted within the current <br />zoning classifications. The owner chose to apply for a comprehensive plan and zoning <br />amendment which would allow their use. The owners invited neighbors in on June 20th <br />to explain their situation. <br /> <br />3.0 PROJECT REVIEW <br /> <br />3.1 Ms. Agness has proposed interior remodeling and changing the uses to office and <br />meeting space.
