<br />. <br /> <br />9. No exterior storage on the site shall be permitted. No commercial vehicles may be <br />parked or stored on the site. <br /> <br />10. Signage shall be non-lighted, non-flashing, non-moving, and shall not exceed 75 s.f. <br />including the building wall signage and the lawn monument signage. <br /> <br />11. The interim use permit shall expire on September 24, 2006, unless an application is <br />submitted for a five year extension of the permit in the May, 2006. Upon the <br />expiration date of the initial term of the interim use permit, as established by the City <br />Council, the permit shall automatically expire without action of any kind unless the <br />permit is extended in accordance with Subsection 11 of this Section. <br /> <br />12. Applications for extension shall be filed 120 days prior to the expiration date of the <br />original permit, or the expiration of any extension thereof. Unless the original permit <br />was expressly declared to be nonrenewable, the interim use permit may be extended <br />for additional terms of not more than five (5) years each if the City Council makes all <br />of the findings set forth in this resolution at of the time of each renewal. The City <br />Council shall be the approving authority for any or all extensions of the permit. The <br />Council may refer the application for extension to the Planning Commission for <br />study and recommendations action thereon if the Council determines that special <br />problems or circumstances may exist with regard to the proposed extension. There is <br />no vested right or legal entitlement to an extension and the decision on any <br />application for extension shall be within the sole discretion of the City Council. <br /> <br />13. The City Council shall, in all cases, retain continuing jurisdiction over each such <br />permit and may, at any time, either on its own initiative or in response to a violation <br />of the terms of the permit, modify or delete any conditions of the permit or impose <br />any new conditions if necessary in order to preserve the public health, safety and <br />welfare, or to prevent the creation or continuance of a public nuisance, or where such <br />action is necessary to preserve or restore any of the findings set forth in this <br />resolution. Prior to Council action, the Planning Commission shall conduct a public <br />hearing on the proposed modification to the permit conditions and notice thereof <br />shall be given in the same manner as prescribed in Section 108 and Section 1012. <br /> <br />14. Violations of the terms of this Interim Use Permit shall be considered grounds for <br />revocation of the Interim Use Permit at anyone time or grounds for denial of a <br />permit extension to a further five year period. An interim use permit may be revoked <br />upon a determination by the City Council that the holder of such permit has failed to <br />comply with any of the conditions thereof or has violated any applicable provision of <br />the City Code. Prior to Council action, the Planning Commission shall conduct a <br />public hearing on the revocation and notice thereof shall be given in the same manner <br />as prescribed in Section 108 and 10 12. <br />
