Sherren Street <br /> <br />RE: <br /> <br />Request by Kathleen Agness (Schorn Realty) for a Comprehensive Land <br />Use Plan Amendment and Rezoning or an Interim Use Permit on <br />property located at 2256 Lexington Avenue <br /> <br />As property owners of land that abuts the property at 2256 Lexington Ave. on the south <br /> <br />side, we are directly impacted by the request for Rezoning or Interim Use Permit. We <br /> <br />agree with the Staff recommendation to the Planning Commission to deny the rezoning <br /> <br />request and approve a five-year interim use permit for an office only (with conditions); <br /> <br />however, with one key exception. <br /> <br />In the document titled, "Request for Planning Commission Action", Item 4.5 says that <br /> <br />if the change in zoning from R -1 to B-1 occurs, the screened buffer and landscaping are <br /> <br />insufficient, and because this is a pre-existing use this buffer could be partially attained <br /> <br />through fencing and landscaping. This statement appears to be contingent on rezoning <br /> <br />requirements. <br /> <br />Because the recommendation to the Planning Commission is to deny the rezoning <br /> <br />request and approve an Interim Use Permit, we question why Item 5 in the Planning <br /> <br />Commission Draft is a requirement? Item 5 states: "Within 90 days of the permit <br /> <br />approval, the applicant shall construct and or repair screening fences (and/or plant <br />
