<br />RESOLUTION NO. <br /> <br />RESOLUTION APPROVING AN INTERIM USE PERMIT FOR KATHLEEN <br />AGNESS dba SCHORN REAL ESTATE AND RIVERDALE MORTGAGE TO <br />ALLOW REAL ESTATE AND MORTGAGE OFFICES AS A FIVE YEAR <br />INTERIM USE AT 2256 LEXINGTON AVENUE. (PF3329) <br /> <br />WHEREAS, Kathleen Agness, dba Schorn Real Estate and Riverdale Mortgage, <br />has requested an interim use permit to allow the placement of an office for real estate and <br />mortgage uses at 2256 Lexington Avenue, and <br /> <br />WHEREAS, Section 1012.09A states: the City Council may authorize an interim use <br />permit of property. Interim use may not be consistent with the land uses designated on the <br />adopted Land Use Plan. They may also fail to meet all of the zoning standards <br />established for the district within which it is located; the term "interim use" generally <br />means a use that is not expressly authorized in the City Code, or any other regulations <br />applicable to an area or any portion thereof, provided such use is not an expressly <br />prohibited use as described in Section 1004 ("R-l" Single Family Residential Zone) of <br />the City Code; and <br /> <br />WHEREAS, the Planning Commission has recommended, on the basis of the <br />application and the evidence submitted, the following findings: <br />1. That the proposed office within a residential structure interim use and the <br />conditions under which it would be operated will not be detrimental to the <br />public health, safety or welfare, or injurious to properties or improvements in <br />the vicinity; <br />2. The proposed office interim use will not create any significant unmitigated <br />adverse environmental impacts, <br />3. The proposed office interim use will not obstruct, interfere with, or delay the <br />intended preservation or redevelopment of the property in accordance with the <br />uses anticipated in the comprehensive plan or any other adopted specific plan <br />applicable to the site; <br />4. All public utilities and other infrastructure improvements required in order for <br />the office interim use to be conducted in a safe, sanitary, and lawful manner <br />are either available at the site or shall be installed by the applicant, prior to <br />occupancy, in a manner approved by the city engineer; <br />5. The use will provide either or both of the following benefits: <br />a. A benefit to the property, including, but not limited to, the elimination <br />of blight or unsightly or hazardous conditions, or the installation of <br />improvements and occupancy that will facilitate preservation or <br />redevelopment of the property, and/or <br />b. A benefit to the public, such as the creation of jobs, revenues, or the <br />provision of needed goods or services, and <br /> <br />1 <br />
