Plan nine: File 3329: Agness/Shorn Office - Interim Use Permit <br /> <br />When Kathleen Agness requested an Interim Use Permit (City Code <br />Section I 0 12.09) on the property located at 2256 Lexington Ave to establish a <br />realty and mortgage office, the Council adopted Resolution 9941 (September 24, <br />2001) which states that an annual administrative review be done and reported to <br />the Planning Commission and City Council. Dennis Welsch explained the staff <br />report. <br /> <br />Kathleen Agness is legally operating an interim use office which includes Schorn <br />Realty and River Valley Mortgage, at 2256 Lexington Avenue in a residential <br />building formerly known as the Rymer Music Academy and formerly a single <br />family home within an "R-I" Single Family zoning district. To date the zoning <br />remains "R-I"; the Comprehensive Plan remains "LDR" Low Density <br />Residential. <br /> <br />One of the purposes of the Interim Use Permit is to preserve the character of the <br />original residential architecture and site improvements and the compatibility with <br />the existing neighborhood. <br /> <br />The Council determined that the proposed office within a residential structure <br />was an interim use. <br /> <br />The City has received two types of comments from neighbors: I) Fix the <br />damaged fence and 2) maintain the front, side, and back yard. No comments or <br />reports have been submitted by police, fire, or building inspection. <br /> <br />Motion: Member Duncan moved, seconded by Member Pepper to recommend <br />approval to the City Council (regarding conformance with the conditions of the <br />IUP and continuance of the Agness/Schorn Interim Use Permit), but also that the <br />City not offer the Borders and Buffers program as a fence solution. <br /> <br />Ayes: 3. Duncan, Bakeman, Peper <br />Nays: 2, Stone, Traynor <br />Motion carried. <br /> <br />Member Bakeman asked for clarification of the fence ownership.
