<br />Attached to and part of Roseville Covenant Church Variance Application <br /> <br />"Undue Hardship due to Section l004.02A4 of the Roseville City Code" <br />Line Item #7 <br /> <br />Roseville Covenant Church (RCC) respectfully requests a variance of <br />Section 1004.02A4 of the Roseville City Code to comply with zoning laws <br />as the church will be purchasing a residential duplex located at 1380 County <br />Road C2 West RosevilleMN. <br /> <br />Section 1004.02A4 of the City code states that no church building shall be <br />nearer than thirty feet to any adjacent lot in an R district. After RCC <br />purchases this duplex, there will be a violation in this code as the property <br />line of the duplex located next door to the west is approximately fifteen feet <br />away. <br /> <br />In order for RCC to comply with the strict interpretation of this code, it <br />would be necessary to move the duplex structure at 1380 County Road C2. <br />The work and expense involved in this effort would be prohibitive. If we are <br />forced to move the duplex in order to comply with code, the church will <br />have to resell the duplex property and find other means of expansion. <br />Another alternative to comply with the code would be to remodel the duplex <br />and make it smaller. This option would hinder our intended use of the <br />building and also be cost prohibitive. <br /> <br />RCC believes that the use of this duplex as stated in our letter to the City <br />Planner of June 12, 2001 does not alter the current residential zoning of this <br />property in a significant manner. It is our intention that the church staff and <br />church members use the south side of the duplex as an entrance. Signage <br />will be placed on the church building and parking lot directing people to use <br />the south entrance of the building. Parking of cars owned by these <br />individuals would be on the church parking lot rather than the street. <br />Consequently, the neighborhood should have very little change in traffic or <br />extra-parked cars <br /> <br />Some remodeling of the interior may take place with proper building permits <br />but no change will take place to the footprint of the house. The physical <br />appearance of the duplex will not change and continue to look like a <br />residential duplex as it has in the past. Allowing the variance in this instance <br />should not change the effect of a residential zone classification. The intent <br />of residential zoning would not be affected by the variance of Roseville <br />Covenant owing this duplex. <br />
