Mayor Roe admitted that a problem with the current <br /> legislation was requiring cities to go through this process to get trash to responsi- <br /> ble facilities; and suggested it would be prudent for Ramsey County and or the <br /> State Legislature to change the system to state that all trash had to be sent to a <br /> waste/energy facility in Ramsey County and that would save much angst and has- <br /> sle for cities and address the larger environmental concern related to this issue. <br /> Councilmember McGehee stated that she had personally researched that, and the <br /> City had the ability to put that in as a condition of licensure for the City. Coun- <br /> cilmember McGehee noted that she had brought that up a year ago, that any and <br /> all haulers licensed to pick up in trash in Roseville had to deliver it to a burner. <br /> However, Councilmember McGehee stated that the City Council majority had <br /> chosen not to do that. <br /> City Attorney Gaughan stated that he suspected that was not the actual case for a <br /> license condition, and at the direction of the City Council, offered to look into that <br /> again as he had done in the past. Mr. Gaughan advised that this came under <br /> "equal protection" concerns if enacting legislation requiring trash go to a particu- <br /> lar state over another, and while there may be some ways to get around those <br /> equal protection concerns, he would have similar concerns if legislation was <br /> passed along those lines. Mr. Gaughan advised that there was a distinction, that <br /> parties entering into a contract can agree on any negotiated terms (e.g. City of Ro- <br /> seville with haulers) and could make that be a negotiated clause in the contract to <br /> get around equal protection issues. <br /> Mayor Roe suggested additional feedback from City Attorney Gaughan, if the <br /> State would be creating the same marketplace for all by dictating where trash was <br /> hauled. <br /> c. City Communication Efforts (additional agenda item) <br /> Councilmember Laliberte recognized recent efforts and direction to staff to cen- <br /> tralize communication efforts and issues, with the $40,000 fee for rebranding, <br /> with the website the first step. However, in her review of the upcoming HRA <br /> meeting agenda scheduled for October 21, 2014, Councilmember Laliberte noted <br /> her frustration in seeing their apparent intent to move forward to expand their ta- <br /> gline from the "Living Smarter" campaign to incorporate business interests. <br /> While supportive of the efforts to involve the business community, Councilmem- <br /> ber Laliberte expressed concern that this seemed to be reverting to departments <br /> working in "silos" again rather than in concert with each other to effectively use <br /> resources. Councilmember Laliberte stated that she did not want to have separate <br /> HRA and City initiatives; and while understanding the cost of taglines and brand- <br /> ing, opined that a bigger discussion was needed relative to timing,purpose, etc. <br /> City Manager Trudgeon apologized for any misunderstanding or if the HRA <br /> seemed to moving ahead too soon and responded that the process needed to be <br />
