Criteria for Issuance of Spe~al Use Permit~ <br />When reviewing <1n application for a special Use Permit, tbe <br />Planning Commission and Council shall consider the following <br />criteria: <br /> <br />, <br /> <br />1. Impact on traffic. <br />2. Impact on parks, streets, and other public facilities. <br />3. Compatibility of the site plan, internal traffic circula- <br />tion, lar.dscapinq and structures with contiguous properties. <br />4. Impact of the use on the market value of contiguous <br />properties . <br />5. Impact on the general publi~ health, safety and welfare. <br />6. Compatibility with the City's Comprehensive Plan. . <br /> <br />The Council may attach reasonable conditions to the special Use <br />Permit. ~he audition of such cond1tions shall canstitu~e a <br />finding that the conditions are necessary and reasonable. <br /> <br />12.040. Variances for HardshlQ"- <br />Where there are practical difficulties or unusual hardships in <br />the way of carrying out the strict letter of the provisions of <br />this Coda, the Council shall have the power, in s specific case <br />and after notice and public bearinq, to var~ L1Y such provision <br />in harmony 'With the general purpose and intent thereof, and may <br />impose such additional conditions as it cone!.ders necessary so <br />tbat the public health, safety and general welfare may be <br />secured and substantial justice done. - <br /> <br />12.050. Frocedure for '-ariancQ.$J I <br />Any owner of land may file an application for a variance by <br />payinq the amount set forth in Section 15.030 with an <br />Abstractor's certified Property Certificate showing the property <br />owners within 25C feet of the outer boundaries of the parcel of <br />land on which the vari:~"ce ~s requested. The application shall <br />then be heard ~~ the Planning commission upon the same published <br />notice, mailing notice and hearing procedure as set for"'h in <br />Section \6.020. The matter shall then be heard by the council <br />without a public hearing. <br /> <br />( <br /> <br />- <br /> <br />12',.055. Propedure for Mino: Variances. <br />An owner of land ~ay file an &pplication for a minor variance, <br />as defined in Paragraph 1 below, by paying a fee of $25.00.
