Pl ease be <br />assured that thi s work on Lot 3 is bei ng done as part of the <br />over-all road, utility and site grading and drainage system, which <br />must work together for the entire subdivision. Of course, the <br />rough grading on Lot 3 will work for a restaurant as well as any <br />other likely development which might occur in the future on Lot 3. <br />Existing grades on the west side of Lot 3 were high relative to <br />the private street now under construction and to Lot 4. The east <br />side of Lot 3 was low re 1 a ti ve to the pri va te street and the <br />adjacent Lot 4. The rough grading done on Lot 3 will reduce these <br />grade differentials and will allow drainage to flow to the <br />designated ponding area on Lot 5. This rough grading work is <br />consistent with the over-all grading and drainage plans for the <br />subdivision, which plans have been reviewed by the City and the <br />Rice Creek Watershed District as part of the approvals for the <br />various earlier developments on Lots 1 and 2 and now on Lot 4. The <br />grading work on Lot 5 is also being done to provide the necessary <br />ponding area for the entire subdivision. <br /> <br />It is my understandi ng that a gradi ng permi t was not secured by <br />the contractor, our engineers or us for this rough grading work. <br />Apparently, it was not considered as part of the bank site or road <br />and utility work all of which is being carried out by the same <br />contractor. This was an oversight and not called to anyone,'s <br />attention at the pre-construction meeting which included the City <br />staff.
