The <br />city would in~lude the area within the easemen~ wher. c01llputing <br />density and/or ~rea requirements. However, we cannot disregard <br />the easement when applying setb~ck 5tandards. Any deviaticn from <br />setback standards would have to be reviewed on a cas~ by case <br />basis either through the creation and approval of a PUD or <br />through the approval of a variance. Wnile I caM10t speak for <br />the Council who ,"ould ul timately have to approve a. PUD or <br />variances, it is .y belief that the City would be willing to <br />consider reasonable variances. <br /> <br /> <br />I agree that the transfer should occur by a transfer with the <br />retention of an easement in favor of the City for liqht rail <br />puq)oses. I have attached the legal description of the property <br />to be conv~yed.
