<br />and/or prope11ies, In the event that the City elects not to develop the additional <br /> <br /> <br />information requested by the MPCA at this time, the MPCA may determine that a <br /> <br /> <br />portion of the AGI is either inadequate or adequate conditioned upon obtaining <br /> <br /> <br />additional information for all or any portion of the Site. Based on the response <br /> <br />from the City, or lack thereof, the MPCA reserves the authority to take any <br /> <br />appropriate actions with respect to any release, threatened release or other <br /> <br />conditions identified at the Site. The MPCA may determine that the ground water <br /> <br />investigation is adequate to satisfy the investigation requirements for the entire <br /> <br />Site or only specific properties within the Site. The determination may also <br /> <br />identify the additional information which must be developed in order to determine <br /> <br />the adequacy of investigation for specific properties within the Site, or the <br /> <br />conditions which must be fulfilled in order for the adequacy requirements to be <br /> <br />met for all or part of the Site. <br /> <br />C. Duration of Determination(s). The detennination of the MPCA with regard to <br /> <br />the adequacy of investigation may also incorporate conditions relating to the <br /> <br />duration of the adequacy determination, the tennination of the adequacy <br /> <br />detem1ination based on subsequent land use and requirements relating to <br /> <br />continued ground water quality monitoring and other elements. A determination <br /> <br />of the adequacy of an investigation for a portion of the Site or a property shall <br /> <br />remain in dfect for two years provided that no change in the use of the property <br /> <br />which could impact the adequacy has occurred or no new infonnation regarding <br /> <br />other potential or actual releases have been identified.
