Planning Commission Recommendation: Denial w/findings - 11/14/01. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 On August 13, 1990 Mr. Hoff received a minor variance to allow construction ofa <br />detached garage five feet from the front property line. The minor variance process (no <br />longer used by the City) required the signatures of adjacent property owners supporting <br />the variance being requested. Mr. Hoff did receive the necessary signatures and City <br />support for the 25-foot front yard setback encroachment. The minor variance site plan <br />(attached) included the other improvements that would occur on the property, including <br />the installation of a retaining wall and installation of a fence. However, the minor <br />variance approved by the City Council did not include an allowance for a 6-1/2 foot tall <br />fence. <br /> <br />2.2 In April 2001, the Community Development Department issued a building permit to Mr. <br />Hoff for the replacement and expansion of his existing wood fence to the shoreline of <br />Lake McCarrons. However, this building permit was issued in error. The inspector who <br />reviewed and issued the fence replacement/addition permit inadvertently overlooked <br />Section 10l2.02B2 and its four foot maximum fence height allowance in a front yard. <br />Upon becoming aware of this error, the inspector notified the contractor of the height <br />limit for the section in the front yard. <br /> <br />PF3347 ReA 112601 Page 1 of 5 <br />
