REQUEST FOR COUNCIL ACTION DATE: 06-09:-97 ITEM NO: C-7 Ma Agenda Section: Consent Item Description: David and Bonnie Ringsred request for a minor variance at 2270 Western Avenue N (PF#2921). 1.0 REQUESTED ACTION 1.1 David and Bonnie Ringsred are requesting a minor variance to allow the relocation and placement of a residential driveway less then 30 feet from the right-of-way of the intersection of Minnesota Avenue Wand Western Avenue N at 2270 Western Avenue N. Requirement Proposal Variance Driveway setback - 30' from right-of-way 12' setback 18' variance 2.0 BACKGROUND 2.1 David and Bonnie Ringsred own a home at 2270 Western Avenue N. The property is zoned R-1 Single Family Residential and all adjacent land uses are single family residential. 2.2 Mr. and Mrs. Ringsred are requesting a variance to allow the relocation and placement of a driveway 12 feet from the right-of-way of the intersection of Minnesota Avenue Wand Western Avenue N. The existing driveway is located right at the intersection of the two rights-of-way and needs to be moved in conjunction with the improvements to Western Avenue N. In order to meet the 30 foot setback requirement, three mature oak and elm trees would need to be removed. While the proposed relocation does not meet the 30 foot setback requirement, it does improve upon the existing situation. 2.3 Section 703.04B requires driveways in R-1 and R-2 zoning districts to be set back at least 30 feet from the right-of-way of a street intersection. 3.0 MINOR VARIANCE COMMITTEE 3.1 The request for the variance included the required application form, sketch of the driveway, written statement from the applicant, and written approval from the adjacent property owner affected by the variance (Inez Taugner at 2271 Western Avenue N).
