<br />lots. The Code does not anticipate a single-family residential lot of 5 acres or <br />more in size. The code also does not go beyond a typical residential lot size <br />when determining restrictions for accessory structure size and whether a larger lot <br />warrants a larger accessory structure and whether the structure is compatible with <br />the property and the adjacent neighborhood. <br /> <br />B. The plight of the landowner is due to circumstances unique to the property not <br />created by the landowner: Advent Lutheran Church has created the need for a <br />variance with their proposal for a 1,200 square foot accessory structure. <br />However, the Church property has a rear yard allowance of 4,860 square feet, <br />which the City Code does not contemplate. The parcel is large at approximately <br />226,512 square feet (5.2 acres) and is unique when administering Section 1004.01 <br />of the Roseville City Code. <br /> <br />C. The variance, if granted, will not alter the essential character of the locality: <br />The proposed 1,200 sq. ft. detached accessory building would not alter the <br />essential character or the locality, nor adversely affect the public health, safety, or <br />general welfare, of the city or adjacent properties. <br /> <br />5.0 STAFF CONDITIONAL USE PERMIT FINDINGS <br /> <br />5.1 Section 1004.01A4 reads: Requirements For Increasing Maximum Size: The size of <br />detached accessory buildings may be increased from a total of 864 square feet to a <br />maximum total size of 1,008 square feet. A public hearing and approval of a conditional <br />use permit in accordance with Section 1013.01 of this Title, and provided all other <br />applicable provisions of this Section are met, is necessary. Conditions may be attached <br />to the permit to mitigate the impact on adjacent properties, including, but not limited to, <br />increased setbacks, landscape screening, architectural color and detail requirements, <br />drainage provisions, and limiting additional exterior storage. When reviewing an <br />application for a conditional use permit, the Planning Commission and City Council shall <br />consider the following criteria: <br /> <br />1. Impact on traffic. <br />2. Impact on parks, streets and other public facilities. <br />3. Compatibility of the site plan, internal traffic circulation, landscaping and <br />structures with contiguous properties. <br />4. Impact of the use on the market value of contiguous properties. <br />5. Impact on the general public health, safety and welfare. <br />6. Compatibility with the City's Comprehensive Plan.:; <br /> <br />5.2 Staff has reviewed the development proposal with regard to the criteria in Section <br />1013.01.D of the Roseville Zoning Ordinance and concludes the following: <br /> <br />A.
