3.0 STAFF COMMENT

3.1 Last winter Mr. Te1stad's shed sustained roof damage from snow. Mr. Te1stad uses the
shed to store a snow blower and other yard/garden items and he desires to replace the
shed given its age versus placing a new roof over the structure. The existing shed is an
older metal shed that has an aged appearance. The roof is currently being propped-up
from within the structure.

3.2 Section 1004.01A2 reads as follows: Garden Shed: The size ofa the allowed garden
shed shall be limited to a maximum area of 120 square feet and a maximum height of 12
feet. The one allowable garden shed shall not be considered an accessory building.

3.3 The proposed 10 foot by 10 foot (100 square foot) garden shed meets the requirements of
Section 1004.01A2 of the Roseville City Code.

3.4 Section 1004.01A8 reads as follows: Minimum Setbacks: A garden shed and/or an
accessory building shall be set back a minimum of 5 feet from a side yard or a rear yard
lot line and a minimum of 6 feet from any other building or structure on the same lot or
parcel.

3.5 Because the existing garden shed lies within (2-1/2 feet) the required five foot side yard
setback the shed has been determined to be non-conforming to Section 1004.01A8 for
just the side yard setback and requires a variance to be replace in the same location.

4.0 STAFF VARIANCE FINDINGS

4.1 Section 10 13 .02 requires the applicant to demonstrate a physical hardship and to
demonstrate that no practical alternatives exist that would reduce the need for a variance

4.2 Variance may be granted where the strict enforcement of the literal provisions of the
ordinance would cause "undue hardship". The granting of a variance shall only occur
when it can be demonstrated that such an action will be in keeping with the spirit and
intent of the ordinance.

4.3 "Undue hardship" as used in connection with the granting a variance means the property
in question cannot be put to a reasonable use if used under conditions allowed by the
official controls, the plight of the land owner is due to circumstances unique to the
property not created by the land owner, and the variance, if granted, will not alter the
essential character of the locality. Specific to this request:

A. The property in question cannot be put to a reasonable use if used under
conditions allowed by the official controls: The City staff has determined that
the property can be put to a reasonable use under the official controls if the shed
were to be relocated elsewhere. However, this shed has been located in its current
location for many years, and as such has a particular use directly associated with
the driveway. Locating the shed on the opposite side of the driveway would

PF3349 ReA 112601 Page 2 of 4
